Resolution No. 59 of 2013

 

Authorizing the Approval of an

Interlocal Cooperation Agreement

Among Salt Lake City Corporation, Utah Transit Authority,

South Salt Lake City and Salt Lake County for

Sugar House Corridor Management

 

 

WHEREAS, Title 11, Chapter 13, Utah Code Ann., 1953, allows public entities to enter into cooperative agreements to provide joint undertakings and services; and

 

WHEREAS, the Utah Transit Authority (“UTA”) is a public transit district, which presently owns and operates a high capacity fixed guideway system serving portions of the Salt Lake Valley; and

 

      WHEREAS, UTA owns a discontinued rail corridor known as the Sugar House Branch (hereafter referred to as the “Rail Spur”) which runs easterly from UTA’s North/South TRAX light rail corridor for approximately two miles through Salt Lake City and South Salt Lake at approximately 2200 South, all within Salt Lake County;

      WHEREAS, UTA, Salt Lake City and South Salt Lake have been engaged in a project to design, construct and operate a streetcar system along the Rail Spur (the “Project”), and entered into that certain Interlocal Agreement dated December 13, 2011 (the “Project ILA”), which Project ILA governs UTA’s and the Cities’ roles and responsibilities with respect to the Project;

      WHEREAS, the Project ILA outlined the goal of transforming the Rail Spur into an integrated corridor shared by the streetcar Project, a recreational trail, walkways, plazas, and open spaces (the “Sugar House Corridor”); 

      WHEREAS, the County is engaged in a project to connect the Parley’s Trail from the Jordan River Trail to Sugar House Park, and the Parties agree that inclusion of the Parley’s Trail in the Sugar House Spur will enhance the Sugar House Corridor;

      WHEREAS, the Project ILA called for the creation of Sugar House Corridor Management Policies to identify how the parties will operate together within the Rail Spur;

      WHEREAS, the Parties desire to adopt the Sugar House Corridor Management Policies, to enter into reciprocal license agreements providing for the use of certain City-owned property for the Project and the use of certain UTA-owned property by the Cities and County, and to otherwise document each Party’s respective roles and obligations with respect to the development, management, and maintenance of the Sugar House Corridor; and

 

WHEREAS, the attached agreement has been prepared to accomplish such purposes;

 

THEREFORE, BE IT RESOLVED by the City Council of Salt Lake City, Utah, as follows:

 

1.    It does hereby approve the execution and delivery of the following:

 

Interlocal Cooperation Agreement Among Salt Lake City Corporation, Utah Transit Authority, South Salt Lake City and Salt Lake County for Sugar House Corridor Management

 

2.    Ralph E. Becker, Mayor of Salt Lake City, Utah, or his designee, is hereby authorized to approve said agreement on behalf of Salt Lake City Corporation, subject to such minor changes which do not materially affect the rights and obligations of the City thereunder and as shall be approved by the Mayor, his execution thereof to constitute conclusive evidence of such approval.
