RESOLUTION NO. 48 OF 2013
Canvassing, accepting and approving the results of Local Opinion Question Number One held in Salt Lake City, Utah.
WHEREAS, the City Council directed the City Recorder to submit Local Opinion Question Number One to the registered voters of Salt Lake City using a “vote by mail” process similar to the process used by Salt Lake County in a general election; and
WHEREAS, on or before September 9, 2013 the City Recorder caused to be mailed the voter information pamphlet and ballot to every Salt Lake City resident who was registered to vote as of August 31, 2013; and
WHEREAS, all ballots postmarked by September 26, 2013 or received by the office of the City Recorder by 5:00 p.m. on September 26, 2013 have been counted; and
WHEREAS, the City Council must meet to canvass the returns of the Opinion Question at the usual place of meeting no later than 14 days after the close of voting per Salt Lake City Code Section 2.69.070; and
WHEREAS, on October 8, 2013, the Council canvassed the returns of the Opinion Question; and
WHEREAS, the Council has determined that the Opinion Question and voting were conducted in compliance with the Salt Lake City Code.
NOW, THEREFORE, BE IT RESOLVED by the Salt Lake City Council as follows:
Section 1. The Council hereby accepts and approves the voting results for the Opinion Question.
Section 2. The Council certifies the vote totals for and against the Opinion Question and declares the following voting results:
Total Number of Ballots Mailed: 80,827
Total Number of Ballots Voted: 19,607 (24%)
FOR: 17,229
AGAINST: 1,990
Not counted for various reasons: 388
Section 3. For purposes of Salt Lake City Code Section 2.69.070, the City Recorder shall make a certified abstract of the record of the canvassers detailing the votes cast on the opinion question.
Section 4. The Mayor may resolve any issues relating to the canvassing process that are not governed by Salt Lake City Code Section 2.69.070.
Section 5. The City Recorder shall:
a. Record or file the certified Local Opinion Question Results Report in a book kept for that purpose;
b. Publish a copy of the certified Local Opinion Question Results Report in a newspaper with general circulation in the jurisdiction of the Board, and post it in one or more conspicuous places within the jurisdiction of the Board; and
Section 7. This Resolution shall take effect immediately upon its adoption.
