RESOLUTION NO. 39 OF 2018
A resolution extending the time period for satisfying
the conditions set forth in Ordinance No. 18 of 2012.

WHEREAS, the city council enacted Ordinance No. 18 of 2012 on April 3, 2012; and
WHEREAS, that ordinance imposed certain conditions and required that those conditions be met within one year from the date that the ordinance was approved; and
WHEREAS, the ordinance also provided that the city council may extend the time period for satisfying the conditions set forth in the ordinance; and
WHEREAS, on April 2, 2013, the city council adopted Resolution 13 of 2013, which extended the deadline for the Applicant to satisfy the aforementioned conditions to April 3, 2015; and
WHEREAS, on March 24, 2015, the city council adopted Resolution 9 of 2015, which further extended the deadline for the Applicant to satisfy the aforementioned conditions to April 3, 2016; and
WHEREAS, on March 15, 2016, the city council adopted Resolution 7 of 2016, which further extended the deadline for the Applicant to satisfy the aforementioned conditions to April 3, 2018; and
WHEREAS, on March 20, 2018, the city council adopted Resolution 15 of 2018, which granted the Applicant until October 3, 2018, by which time the applicant should either satisfy the conditions set forth in Section 2 of Ordinance 18 of 2012 or enter into a development agreement with the city to address how it will satisfy the conditions set forth in Section 2 of Ordinance 18 of 2012; and
WHEREAS, the Applicant and the city have been working towards preparing a development agreement that is satisfactory to both parties, but have encountered some difficulties; and
WHEREAS, the city and the Applicant are continuing these efforts to reach an agreement; and
WHEREAS, the City Council finds that there is good cause to extend the deadline for meeting the conditions in Ordinance 18 of 2012 for an additional period;
NOW, THEREFORE, be it resolved by the City Council of Salt Lake City, Utah:
SECTION 1. The deadline set forth in Section 4 of Ordinance No. 18 of 2012 as modified by Resolution 13 of 2013, Resolution 9 of 2015, Resolution 7 of 2016, and Resolution 15 of 2018 shall be and hereby is extended to April 3, 2019 for the Applicant to either satisfy the conditions set forth in Section 2 of Ordinance 18 of 2012 or to enter into a development agreement with the city to address how it will satisfy the conditions set forth in Section 2 of Ordinance 18 of 2012 to the satisfaction of the city.
