JOINT RESOLUTION

OF SALT LAKE CITY (Resolution No. 26)

 AND OF THE

SALT LAKE CITY MOSQUITO ABATEMENT DISTRICT (Resolution No. 9a-21-2017)

DECLARING AN INTENT TO ADJUST THE BOUNDARY

OF THE

SALT LAKE CITY MOSQUITO ABATEMENT DISTRICT WITHIN SALT LAKE CITY

 

        WHEREAS, Salt Lake City (the “City”) is an incorporated municipality and is the capital city of the state of Utah; and

 

        WHEREAS, the SLC Mosquito District (the “District”) provides the following service, primarily within the boundaries of the City: abatement or control of mosquitos and other insects; and

 

        WHEREAS, relatively small portions of the City are legally part of the Magna Mosquito Abatement District or the South Salt Lake Valley Mosquito Abatement District, which areas will be the subject of boundary adjustment proceedings between the District and each of the other mosquito abatement districts; and

 

        WHEREAS, there are also relatively small portions of Salt Lake City that are not part of any mosquito abatement district, which unincorporated areas are the subject of this Resolution; and

 

        WHEREAS, having considered the matter, the City Council and the Board of Trustees of the District have concluded that it may be in the best interests of the City and the District and of the property owners and future residents in the affected area within the City to adjust the boundary of the District to include each and every portion of the City that is not included within the Magana Mosquito Abatement District or the South Salt Lake Valley Mosquito Abatement District, without affecting in any way the boundaries or jurisdiction of the City, in accordance with the requirements of Utah Code Ann. §§ 17B-1-417 and 17B-1-503.

 

        NOW, THEREFORE, BE IT RESOLVED and enacted by the City Council of Salt Lake City and by the Board of Trustees of the Salt Lake City Mosquito Abatement District as follows:

 

1.             That the City Council and the Board of Trustees of the District hereby declare their intent to adjust the boundary of the District such that the “Affected Area,” which is identified in attached Exhibit “A” and incorporated herein by reference, consisting of land located within the City that is not currently located within the boundary of any mosquito abatement district, will be included as part of the District.

 

2.             That this Resolution is adopted by the City Council of Salt Lake City and the Board of Trustees of the District for the purpose of fulfilling and complying with the requirements of Utah Code Ann. §§ 17B-1-503(1) and 17B-1-417(3)(a) to initiate the statutory procedure for adjusting the boundary of the District to include more of the municipality as provided in this Resolution.

 

3.             That the City Council of Salt Lake City shall hold a public hearing on the proposed boundary adjustment at 7:00 p.m. on 21 November 2017 in Room 315 at the City and County Building located at 451 South State Street, Salt Lake City, Utah 84111, and the Salt Lake City Mosquito Abatement District Board of Trustees shall hold a public hearing on the proposed boundary adjustment at 6:00 p.m. on 30 November 2017 at the Salt Lake City Mosquito Abatement District office located at 2020 North Redwood Road, Salt Lake City, Utah 84116, both of which dates are no less than 60 days after the adoption of this Joint Resolution.

 

4.             That a notice that this Resolution has been adopted and that public hearings are to be held shall be provided in accordance with the requirements of Utah Code Ann. §§ 17B-1-417(3)(a)(iii) through -417(3)(c), which notice shall either be published once a week for two successive weeks in a newspaper of general circulation within both the District and the City, with the first publication of the notice to be not later than 14 days after the adoption of this Joint Resolution, or the notice shall be mailed to each owner of property located within the affected area and to each registered voter residing within the Affected Area.  No later than 14 days after the adoption of this Joint Resolution, the notice shall also be published for two weeks on the Utah Public Notice Website.

 

5.             That the required notice may be given jointly by the City and the District.

 

6.             That, after the City Council and the District Board of Trustees have each held a public hearing, the City Council and Board of Trustees may adopt a resolution adjusting the boundary of the District to include the Affected Area unless, at or before the public hearings, the requisite number of written protests to the boundary adjustment have been filed with the City Council and/or the Board of Trustees as provided by law, and may take other steps necessary to complete the boundary adjustment.

 

7.             That, if the requisite number of protests are filed, the boundary adjustment shall be abandoned.

 

8.             That this Resolution has been placed on the agenda of a meeting of the Salt Lake City Council and a meeting of the District Board of Trustees and this action is taken in compliance with the Utah Open and Public Meetings Act.

 

9.             That this Resolution shall take effect immediately when it has been approved by the Salt Lake City Council and by the Board of Trustees of the District in accordance with the dates set forth below.

 

        Approved and passed by the Salt Lake City Council and by the Board of Trustees of the Salt Lake City Mosquito Abatement District on the dates set forth below.
