RESOLUTION NO. 25 OF 2017

A Resolution Authorizing the Waiver of Lease Fees for a Portion of City-owned Public Right-of-Way located at Approximately 200 Rio Grande Street

WHEREAS, Salt Lake City Corporation (“City”) and the State of Utah, Division of Facilities, Construction and Management (“DFCM”) executed a lease agreement (“Lease”) for a portion of City-owned right-of-way located at approximately 200 Rio Grande Street (“Leased Area”).

WHEREAS, DFCM intends to utilize the Leased Area to provide health, safety, and welfare services to certain individuals (“Services”).

WHEREAS, the City executed the Lease in order to allow DFCM to immediately begin providing the Services, and identified sufficient consideration to the City in the short-term.

WHEREAS, the City Council intends to provide nonmonetary assistance in the form of a waiver of lease fees to DFCM (the “Nonmonetary Assistance”) from the date this Resolution is adopted through the term of the Lease.

WHEREAS, Utah Code Section 10-8-2(1)(a)(v) allows public entities to provide nonmonetary assistance and waive fees to and for nonprofit entities, such as DFCM, after a public hearing.

WHEREAS, although Utah Code Section 10-8-2 does not require a study for such nonmonetary assistance, in this case the City’s Administration voluntarily performed an analysis of the public benefits of providing the nonmonetary assistance to DFCM which was included in the transmittal to the City Council before the public hearing (the “Analysis”).

WHEREAS, the City Council has conducted a public hearing relating to the foregoing, in satisfaction of the requirements of Utah Code Section 10-8-2.

WHEREAS, the City Council reviewed the Analysis and has fully considered the conclusions set forth therein, and all comments made during the public hearing.

THEREFORE, BE IT RESOLVED by the City Council of Salt Lake City, Utah, as follows:

1.     The City Council hereby adopts the conclusions set forth in the Analysis, and hereby finds and determines that, for the reasons set forth in the Analysis, the Nonmonetary Assistance is appropriate from the date this Resolution is adopted through the term of the Lease.

Passed by the City Council of Salt Lake City, Utah, this 19th day of September, 2017.
