RESOLUTION NO. 15 OF 2018

 

A resolution extending the time period for satisfying

the conditions set forth in Ordinance No. 18 of 2012.

(Property located at 545 and 555 West 500 North Street)

 

WHEREAS, the city council enacted Ordinance No. 18 of 2012 on April 3, 2012; and

WHEREAS, that ordinance imposed certain conditions and required that those conditions be met within one year from the date that the ordinance was approved; and

WHEREAS, the ordinance also provided that the city council may extend the time period for satisfying the conditions set forth in the ordinance; and

WHEREAS, on April 2, 2013, the city council adopted Resolution 13 of 2013, which extended the deadline for the Applicant to satisfy the aforementioned conditions to April 3, 2015; and

WHEREAS, on March 24, 2015, the city council adopted Resolution 9 of 2015, which further extended the deadline for the Applicant to satisfy the aforementioned conditions to April 3, 2016; and

WHEREAS, on March 15, 2016, the city council adopted Resolution 7 of 2016, which further extended the deadline for the Applicant to satisfy the aforementioned conditions to April 3, 2018; and

WHEREAS, the Applicant has continued to experience difficulties in securing financing to complete the project, which Applicant attributes to the zoning map amendments not yet being in effect and has requested another extension of the deadline in order to satisfy the conditions of Ordinance No. 18 of 2012 or to enter into a development agreement with the city that will provide assurances of satisfaction of the aforementioned conditions in order for the zoning map amendments to become effective prior to actual satisfaction of the conditions; and

WHEREAS, the City Council finds that there is good cause to extend the deadline in the ordinance;

 

NOW, THEREFORE, be it resolved by the City Council of Salt Lake City, Utah:

SECTION 1.        The deadline set forth in Section 4 of Ordinance No. 18 of 2012 as modified by Resolution 13 of 2013, Resolution 9 of 2015, and Resolution 7 of 2016 shall be and hereby is extended to October 3, 2018 for the applicant to either satisfy the conditions set forth in Section 2 of Ordinance 18 of 2012 or to enter into a development agreement with the city to address how it will satisfy the conditions set forth in Section 2 of Ordinance 18 of 2012 to the satisfaction of the city.
