RESOLUTION NO. R-1-2017                                                                                             February 14, 2017

[Interim Use of RDA Owned Real Property]

 

RESOLUTION OF THE BOARD OF DIRECTORS OF THE REDEVELOPMENT AGENCY OF SALT LAKE CITY FOR THE INTERIM USE OF RDA OWNED REAL PROPERTY

 

WHEREAS, the Board of Directors of the Redevelopment Agency of Salt Lake City (the “Board”) desires to implement a policy with respect to the Redevelopment Agency of Salt Lake City’s (“RDA”) interim use of RDA owned real property.

 

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE REDEVELOPMENT AGENCY OF SALT LAKE CITY, that  the following policy will govern the RDA’s interim use of real property until such real property can be redeveloped:

1.         Purpose: When the RDA acquires property that is not planned for immediate reuse, redevelopment, or disposition, every effort will be made to make the property (a) safe; (b) well maintained; and (c) if appropriate, available to the community through an interim use. The RDA will follow all Salt Lake City ordinances with regards to property maintenance and when planning any interim use(s) for properties.

 

2.         Safety:  RDA’s first priority will be to secure all properties to ensure public safety, including by, where appropriate, demolishing or securing of unsafe structures, fencing, regular inspections, and monitored smoke, water, or entrance alarms as necessary.

 

3.         Maintenance:  RDA will maintain all properties, including by performing, where necessary, trash removal, landscaping, glass replacement, graffiti removal, winterizing, lighting, paint, and minor repairs.

 

4.         Interim Use: RDA will, where appropriate, encourage interim uses of properties to reduce the amount of time that the RDA-owned real property remains inactive and/or vacant while the redevelopment process is being executed. The RDA will reach out to other Salt Lake City departments and divisions to notify them when RDA-owned properties are available for interim use. The RDA will also consider, as appropriate, requests from parties outside of the RDA/City to use RDA-owned properties for interim uses.


The RDA will follow best practices in conducting environmental due diligence and investigation when acquiring property and preparing properties for redevelopment, with a goal of facilitating the process and timeline for redevelopment. If, during due diligence at property acquisition or another time, it is determined that environmental remediation may be needed at a property, the RDA may use the interim use time period to conduct such environmental investigation(s) and/or remediation.

 

5.         Budget: Each Interim Use Plan (described below) will include a budget to identify the appropriate level of funding/costs to implement the interim use(s) identified in the plan. The budget will include sufficient flexibility to allow for updates over time to reflect changing market conditions and/or unforeseen events.

 

6.         RDA Interim Use Plan at property acquisition: When the RDA acquires property, staff will work to determine an approximate timeframe for redevelopment and options for interim use(s). This will also apply when properties are acquired for which a permanent reuse has not been determined, and/or when properties are acquired with a known extended timeline for redevelopment. As part of the process for determining interim use(s), the RDA will discuss the interim use options with surrounding property owners and other City departments/divisions, and will then draft an RDA Interim Use Plan as part of the property acquisition process. The Interim Use Plan will include clear discussion of the temporary nature of the interim use(s) proposed and/or an attempt will be made to identify interim use(s) that could potentially be incorporated into the permanent use for the property. When the property acquisition is complete, RDA staff will work to implement the interim use(s) identified in the RDA Interim Use Plan as quickly as possible.

 

7.         RDA Interim Use Plan for properties currently owned by the RDA: For property currently owned by the RDA, the RDA may choose to draft an RDA Interim Use Plan that is not associated with property acquisition, but which will still achieve a temporary, active use of the property, and which will include a budget for implementing the interim use(s) identified in the plan.

 

8.         RDA Interim Use General Goals: The RDA has the following general goals and objectives for interim uses on RDA real property:

a.  Economic Development

i. Examples include supporting local businesses, job training, and small business development.

b.  Community gathering and recreation spaces

i. Examples include community gardens, temporary plazas, and temporary parks.

c.  Support for the Arts

i. Examples include temporary studio space, gallery space, and/or public art installation(s).

d.  Property Activation and Crime Reduction

i. Examples include any active use that brings people to an area for a positive and productive purpose.
