Amended RECORD OF DECISION

Variance for Side Yard Setbacks at approximately 736 E 700 South - Craig Thygerson, property owner, is requesting a variance to construct a single-family home that does not meet the required side yard setback at the above listed property. The subject property is located in the R-2 Single- and Two-Family Residential zoning district. The R-2 zoning district requires a minimum lot width of 50 feet to construct a single-family dwelling. The side yard setbacks to the property line for the R-2 zone are 4 feet on one side and 10 feet on the other. The width of the subject parcel is only 19.5 feet. The Applicant is requesting side yard setbacks of 2 feet and 3 feet which would not meet the setback on either side of the proposed structure, but would maintain the setbacks as they currently exist for the house on the parcel which is to be replaced. Appeal of an Administrative Decision at approximately 2140 E Parley’s Terrace – Craig and Jan Crockett, property owners at 2130 E Parley’s Terrace, are appealing an Administrative Decision to issue a building permit for an accessory structure located in the side yard area at the above listed address. The Appellant is claiming that the accessory structure is a shed building that is not permitted in the side yard and should only be permitted in a rear yard area. The subject property is located in the R-1/12,000 zoning district within Council District 7, represented by Lisa Adams.
