Appeal of Administrative Interpretations at approximately 1432 S 1100 East - Bernardo Flores and Steve Scoville, represented by Bruce Baird PLLC, are appealing two Administrative Interpretations regarding whether or not a driveway that is part of a multi-family use can legally exist in an R-1/5,000 Single Family Residential District. The subject parcel is split zoned with the 1100 East facing portion zoned RB Residential Business where the multi-family would be developed, and a small portion on Roosevelt Avenue zoned R-1/5,000 where a driveway serving that project would be located. The interpretations found that the subject parcel is considered one lot and that  access to a multi-family use on that lot will not be permitted on a portion of the lot zoned  R-1/5,000. Determination of Nonconforming Use Modification at approximately 1845 S 700 East - Parker Robertson of Wadsworth Development Group, is requesting a determination by the Appeals Hearing Officer as to whether the existing nonconforming retail service establishment (dry cleaner) with a drive-through at the above listed property can change to a restaurant (coffee shop) with a drive-through facility. Both retail service establishments and restaurants are permitted uses in the CN (Neighborhood Commercial) zoning district, however the associated drive-through facility is nonconforming. The existing drive-through was approved in 2008 and became a legal nonconforming use when the land use tables for the zoning district changed in April 2014. The zoning ordinance allows one nonconforming use to change to another nonconforming use if the businesses are similar in nature as determined by the Appeals Hearing Officer.
