SJ Auto Body and Sales, LLC Determination of Nonconforming Use Modification – A determination by the Appeals Hearing Officer as to whether an existing nonconforming automobile repair (major) use at approximately 15 N 900 West can change to automobile sales and service/repair. The auto repair business was created at a time when auto repair was allowed on the property. Since then, the zoning has changed so that auto repair is not permitted, but the auto repair business has a right to continue operating. An automobile sales lot is also prohibited, but the zoning ordinance allows one nonconforming use to change to another nonconforming use if the two businesses are similar in nature.
