Appeal of a Planning Commission Decision at approximately 131 S 300 West on Block 67 – The Refugee and Immigrant Center is appealing the Planning Commission approvals of a Conditional Use for a commercial parking lot (PLNPCM2017-00419) and the Planned Development for multiple buildings on one lot (PLNSUB2017-00418) at the above listed property. The appeal is based upon the claim that they did not receive notice. Appeal of a Planning Commission Decision at approximately 131 S 300 West on Block 67 – The Japanese Community Preservation Committee, representing property owners adjacent and across the street to the subject property, is appealing the Planning Commission approval of a Conditional Use for a commercial parking lot (Petition Number PLNSUB2016-00418) at the above listed property. The appeal is based upon the Planning Commission not including specific conditions of approval. The site is located in the D-4 Downtown Secondary Central Business District zoning district and within Council District 4, represented by Derek Kitchen. Appeal Denied – Planning Commission Decision Upheld

 

Appeal of Administrative Interpretations at approximately 1432 S 1100 East - Bernardo Flores and Steve Scoville, represented by Bruce Baird PLLC, are appealing two Administrative Interpretations regarding whether or not a driveway that is part of a multi-family use can legally exist in an R-1/5,000 Single Family Residential District. The subject parcel is split zoned with the 1100 East facing portion zoned RB Residential Business where the multi-family would be developed, and a small portion on Roosevelt Avenue zoned R-1/5,000 where a driveway serving that project would be located. The interpretations found that the subject parcel is considered one lot and that access to a multi-family use on that lot will not be permitted on a portion of the lot zoned R-1/5,000. Appeal Denied – Administrative Interpretations Confirmed

 

Rehearing of a Variance Request at approximately 512 S 800 East - David Richardson, representing property owners Erin and Charles Johnson, is requesting two variances to construct an addition to a single-family home that would not meet the required rear yard setback or maximum lot coverage. The proposed addition would have a rear yard setback of 10.5 feet rather than the required 20 feet, and the lot coverage would be 48 percent exceeding the maximum of 45 percent. The addition is being proposed to accommodate a stairwell which would provide improved access from the main floor to the basement. A hearing was held on June 8, 2017, and the variance requests were denied. Due to a recent state court case involving variances, the Appeals Hearing Officer has requested to rehear the variance case. The subject property is located in the RMF-30 Low Density Multi-Family Residential Zoning District. The subject property is within Council District 4, represented by Derek Kitchen. Variance Request at approximately 810 E Edgehill Road - Pam and Wynn Johnson, property owners, are requesting a variance to construct a new single-family dwelling at the above listed property with a reduced front yard that measures 11 feet in depth instead of being equal to the average of the front yards of existing buildings within the block face as required by 21A.24.040.E of the Zoning Ordinance. Based on already-established front yard setbacks along the block face, Staff estimates that the minimum required front yard for a new single-family structure at this location would be approximately 17.5 feet. The subject property is located in the FR-3/12,000 Foothills Residential Zoning District and within Council District 3, represented by Stan Penfold.
