ADMINISTRATIVE HEARING
The regular administrative hearing for the Salt Lake City Planning Division was held on Monday, July 15, 2002 at 4:45 p.m. at the City and County Building, 451 South State Street, in Room 523. Doug Wheelwright, Deputy Planning Director, was present as the hearing officer and called the meeting to order.
GATEWAY BLOCK A, Parking Units 1 & 2 and Retail Units 3 & 4, Condominium Plat Amendment located at the southwest corner of 100 South and 400 West. Gateway Associates LTD is proposing to amend Parking Units 1 & 2 and Retail Units 3 & 4 of the recorded Gateway Block A Condominium Plat. Gateway Block A includes Lots 1, 6, 7, 8 and a portion of Lots 2, 3, 4 and 5 of Block 65 and is located on 5.718 acres of property and is zoned G-MU – Gateway Mixed Use. (Staff – Greg Mikolash)
Brian Gochnour, representing Gateway Associates LTD, was present.
Mr. Mikolash explained that Gateway Associates LTD is requesting an amendment to Gateway Block A. The amendment is a minor amendment to condo units that were recorded about 1 ½ years ago. A building permit was issued for the project on October 31, 2000 and the plans were routed interdepartmental with comments from each department stating that no additional comments were needed based on the original approval. An insignificant change is proposed for Parking Units 1 and 2 in that a small area is being provided for storage. The change to the boundaries of the Retail Unit 3 and 4 is for the expansion of the planetarium. Mr. Mikolash then explained that the Planning Staff is requesting the Planning Director to approve the amendment based on no additional comments to the original approval from all the departments, and the changes on the boundary lines are very minor.
Mr. Wheelwright noted that no public was in attendance.
THEREFORE, Mr. Wheelwright approved the amendment to the Gateway Block A, Parking Units 1 and 2, and Retail Units 3 and 4.
TRANS Subdivision Amendment located at approximately 835 South Redwood Road. Khiem T. Tran is requesting an amendment to Lots 11, 12, 13, and 14 of Block 3, Evans Addition to the Poplar Grove Subdivision, which will split an existing 11,970 square foot parcel in two for the purpose of constructing a new single-family dwelling on a new 5,628 square foot lot with frontage along Redwood Road in an R-1/5000 Zone. Subdividing the parcel allots 6,342 square feet for the existing single-family dwelling addressed 1668 West Indiana Avenue. (Staff – Greg Mikolash)

Mr. Mikolash explained that Mr. Tran is proposing to amend Lots 11 through 14 of the Evans Addition to Poplar Grove Subdivision. Currently existing is a parcel of land consisting of 11,970 square feet with a single-family dwelling that fronts Indiana Avenue. Mr. Tran is proposing to split the into two parcels that would allot approximately 6,300 square feet for the existing single-family dwelling, and create a lot of 5,600 square feet for a proposed new single-family dwelling that would front Redwood Road.
Mr. Mikolash then reviewed departmental comments. UDOT and the Salt Lake City Transportation Division prefer no approach leading from Redwood Road. The City is asking that the 15-foot alley way be improved and use as access to the property. Improvements include removing obstructing trees and junk, and installing hard-surfacing. The hard-surfacing shall consist of two inches of asphalt and six inches of road base. Mr. Mikolash noted that the Police Department and Fire Department stated concerns regarding the use of the alley way. Mr. Mikolash assured the Departments that the alley would be improved, and that the Transportation Division has no problem with the alley being used for access. He noted that other residents abutting the alley use it and Staff received one telephone call regarding whether or not the alley would be blocked, which it will not. Public Utilities had several comments mostly entailing a fire flow test from the closet fire hydrant. Mr. Mikolash noted no hydrants in the immediate area during the site visit, and the site plan submitted does not indicate one. Mr. Tran is required to install a hydrant if there is not a hydrant within 150 feet. Mr. Tran noted that a fire hydrant exists across the street on Redwood Road. Mr. Mikolash said that he does not know whether or not the use of a hydrant across the street would be permitted or it may be outside the 150-foot limit. The Planning Staff recommends approval for the subdivision amendment provided required permits are obtain for any public way improvements and Mr. Tran must be in constant contact with UDOT for any improvements along Redwood Road because it is a state right-of-way. Building permits may be obtained only after the subdivision is recorded.

THEREFORE, Mr. Wheelwright approved the Tran Subdivision Amendment to the Evans Addition to the Poplar Grove Subdivision subject to meeting the conditions of the Staff Report.
