ADMINISTRATIVE HEARING
The regular administrative hearing for the Salt Lake City Planning Division was held on Wednesday, December 4, 2002 at 5:00 p.m. at the City and County Building, 451 South State Street, in Room 541. Doug Wheelwright, Deputy Planning Director, was present as the hearing officer and called the meeting to order.
FREE Subdivision Amendment by Rod Young requesting to split Lot 7 of Block 2 into two parcels so that the two existing dwellings can be on separate lots. The subject property is .45 acre and is located at approximately 2627 South Green Street in an R-1/7000 Zone. (Staff – Jackie Gasparik)

Ms. Gasparik explained that two structures exist on one lot located at 2627 South Green Street. One structure is a single-family dwelling and the other is a tri-plex. The proposal is to make a property line down the middle of the lot so that each structure could be separately owned.
Ms. Gasparik then reviewed departmental comments. The Transportation Division requires a cross-access easement if the driveway will be continued to be shared. The Petitioners are proposing separate driveways and parking for each structure, so this is no longer an issue. The amendment must also go through a Routine and Uncontest Matter approval for substandard setbacks by the Zoning Administrator, Larry Butcher, and Mr. Butcher is concerned about windows on the structures being too close to the proposed property line. Ms. Gasparik made an inspection and found six windows on the house (three for the main level and three for the basement level) and at least six on the tri-plex. She recommended that the Petitioner obtain a letter from the Building Services and Licensing Division stating that there would be no building code issues. Ms. Gasparik noted that she has provided the Petitioner with a Routine and Uncontested application. Engineering requires one sidewalk panel to be replaced or repaired. Public Utilities noted that the water and sewer might run through the lot where the single-family dwelling is located, and requires a 10-foot easement. The Petitioner should verify whether or not such lines exist, and then provide an easement. If not, the Petitioner should resolve the issue with Public Utilities. The Fire Department raised concerns about building codes regarding the windows, and fire access around the structures. Ms. Gasparik noted that access should not be an issue, and suggested that the Petitioner contact the Fire Department. Ms. Gasparik then explained that the Planning Division recommends approval subject to meeting departmental comments along with the following:
Obtain Zoning Administrator approval of the Routine and Uncontested Matter application.
Provide a letter from the Building Services and Licensing Division stating that there is no issue with the windows.
Obtain a permit from Engineering to work in the public way to repair or replace the sidewalk panel.
Provide a letter from the Fire Department stating whether or not their concerns with building codes and access have been satisfied.
Submit the final plat application. Ms. Gasparik noted that she has provided the Petitioner with the application.
Mr. Wheelwright noted for the record that no calls from the community were received and no one from the public was present to comment of the proposal.
THEREFORE, Mr. Wheelwright approved the amendment to the Free Subdivision subject to meeting the conditions.
