ADMINISTRATIVE HEARING
The regular administrative hearing for the Salt Lake City Planning Division was held Wednesday, December 18, 2002 at 5:00 p.m. at the City and County Building, 451 South State Street, in Room 542. Doug Wheelwright, Deputy Planning Director, was present as the hearing officer and called the meeting to order.
BROOKLYN CONDOMINIUM by Mike Miller of WJC Development requesting preliminary approval for The Brooklyn Condominiums Phase 1 located on the southwest corner of 700 North and 300 West. The condominium ownership proposal is located in a recently constructed 12-unit multi-family residential structure in an “MU” Zoning District on 0.40-acre of property. (Staff – Greg Mikolash)
Mack McDonald, Project Coordinator for the Salt Lake City Redevelopment Agency, was present.
Mr. Mikolash explained that Phase 1 of the Brooklyn Condominium consists of 12 units with 24 parking stalls. One concern that Planning Staff had was the location of the dumpster. Until the second phase is built, the dumpster will be placed at the west entryway where there is adequate space to conceal and cover it. Another concern that Planning Staff has is that a notice of minor subdivision was found which was dated April 2000 to change the subdivision to Jeppsen Subdivision. The Applicant is required to go to the County and make certain that the new boundary lines have been recorded.
Mr. Mikolash reviewed other departmental comments explaining that Engineering has the most concerns and requires submittal of compaction tests for the parking lot driveway and engineering plans for review and approval. Mr. Mikolash noted that the engineering plans could be submitted with the final plat approval application. Mr. Mikolash has provided Mr. Miller with an application and was instructed to also submit the title report and four sets of plans of which one will go to Engineering. The Transportation Division, Public Utilities and Property Management have on problems with the proposal. Mr. Mikolash said that he was unable to contact Brad Larson from the Fire Department, and suggested that Mr. Miller contact Mr. Larson. It was noted that the Fire Department would have reviewed and approved through the building permit process.
Mr. Mikolash said that the Planning Division recommends approval with the conditions that the Applicant meets all Engineering requirements including properly recording the Jeppsen Subdivision, and addressing their concerns about bonding and soils compaction test results.
Mr. Wheelwright explained that Engineering comments are directed toward quality issues. The project originally was for a multi-family rental building in which the property owner would be responsible for maintenance, and the City issued the building permit accordingly. Now that the project is being converted to condominiums, a certain amount of buyer protection review is required. The City may bond for anything that is not completed at the time the condo plat is ready to record because the project started as a rental project, and now being converted to owner/occupied units. The Applicant may also wait to record the plat until the units are ready to be occupied.
Mr. Mikolash noted that final recording should be completed by February or March 2003. Mr. Wheelwright added that from here it is an administrative process, and the Applicants should work closely with Mr. Mikolash to finalize the plat.
Mr. Wheelwright noted for the record that Mr. Mikolash received only one telephone call relative to the subdivision notice and it was in support of the project and the conversion to condos.
THEREFORE, Mr. Wheelwright approved the proposal with the condition that the condominium plat be finalized.
