ADMINISTRATIVE HEARING
The regular administrative hearing for the Salt Lake City Planning Division was held on Thursday, August 22, 2002 at 4:00 p.m. at the City and County Building, 451 South State Street, in Room 542. Doug Wheelwright, Deputy Planning Director, was present as the hearing officer and called the meeting to order.
PIONEER SQUARE INDUSTRIAL PARK PLAT B by Paul Mendenhall, representing John Price Trust, requesting an amendment to Lots 28, 29 and 30 located at approximately 2475 and 2517 West Bridger Road and 1910 South Fremont Drive. (Staff – Jackie Gasparik)
The plat amendment as proposed would adjust the old lot line 30 feet west, creating three new lots, Lot #1 that is vacant, Lot #2 that is vacant and contract with Perma Plate, and Lot #3 that is separately owned and developed.
Paul Mendenhall, representing John Price Trust, and Michael Frei, representing Perma Plate, were present.
Ms. Gasparik explained that the Planning Division received the final plat application before the preliminary plat amendment application. The final plat application was returned to Mr. Mendenhall, and it needs to be resubmitted with the fee and four copies of the red-lined plat.
Ms. Gasparik then explained that Barry Walsh from the Division of Transportation is requiring a cross easement agreement on Lot 30 (new Lot 2), and it must be shown on the site plan per a DRT review on May 19, 2002 for the Perma Plate Development (new Lot 2). It was discussed prior to the hearing that the Petitioners are unaware of any required easements, and they reasoned that a portion of the existing parking lot on new Lot 2 extends onto the abutting lot and shows no easement. This will be corrected with the lot line adjustment in which indicating an easement would not be necessary. Ms. Gasparik suggested that the Petitioners contact Mr. Walsh for clarification. It was further noted that new Lots 1 and 2 are not developed. Perma Plate plans to purchase Lot 2 and is currently going through the building permit process to development the lot.
Ms. Gasparik said that Scott Weiler from the Engineering Division reviewed the existing improvements on the lots and requires the gutter at approximately 2500 West Bridger Road to be replaced with new gutter. New driveway approaches must comply with Engineering Division requirements, and permits to do work in the public way are required. Ms. Gasparik noted that Mr. Weiler also submitted to the Planning Division red-lines for the plat amendment that she forward to Mr. Frei who will forward them to the appropriate development engineers.
The Department of Public Utilities requires the existing 15-foot public utilities easement through Lot 1 to be widened to 30 feet. Mr. Frie explained that the proposed building has already been placed on the lot so that it would not encroach into the easement area. The building will not fit on the lot if the easement is widened. Mr. Wheelwright explained that Public Utilities requires enough width for working space should they ever need to construct a replacement. The easement could possibly be extended toward the east. Ms. Gasparik suggested contacting Brad Stewart who is the Development Engineer in Public Utilities.
The Fire Department requires all new construction on Lots 1 and 2 to be reviewed and approved.
Responding to questions by Mr. Wheelwright, Mr. Frei explained that the Perma Plate development consists of an office/warehouse/manufacturing facility, and because manufacturing is involved, the parking requirements are different. Mr. Frei added that it is critical they begin construction because of the upcoming inclement weather. The plans and specifications were submitted to the City two weeks ago, and they are currently under review. He wishes to be able to obtain the building permit with the understanding that they do not receive a Certificate of Occupancy until the development and plat amendment are completed.
Mr. Wheelwright noted that no public was present for comment. Ms. Gasparik noted that the Planning Division received two calls from surrounding property owners; Bob Clark, Perry Pardoe and Vasilios Preisto. Ms. Gasparik faxed each one a copy of the Staff Report, and assured them that the amendment was only adjusting the lot lines 30 feet to the west. All three gentlemen found the proposal acceptable since it did not affect their properties.
THEREFORE, Mr. Wheelwright approved the proposed amendment.
