ADMINISTRATIVE HEARING

 

The regular administrative hearing for the Salt Lake City Planning Division was held on Tuesday, April 30, 2002 at 4:30 p.m. at the City and County Building, 451 South State Street, in Room 542.  Doug Wheelwright, Deputy Planning Director, was present as the hearing officer and called the meeting to order.

 

Petition #410-585 by Jesse Lassley, representing Cingular Wireless, requesting conditional use approval to install a wireless telecommunications facility consisting of wall-mounted antennas and associated electrical equipment at 40 South 900 East.  (Staff - Janice Lew)

Janice Lew, Associate Planner, explained that the proposal consists of two dual wall-mounted antenna structures at the southeast and southwest corners of the Sunset Towers Building, as well as, two antennas on the western portion of the parapet wall of the north façade.  The antennas meet the regulations of code, but are considered a condition use because the building is over the height limit of the RMF-75 Zone.  The proposal also includes electrical equipment placed in the northwest corner of the roof and exceeds the maximum height limit of 5 feet.  The proposed electrical equipment will be placed on a platform measuring 8 feet by 16 feet which brings the overall height of the equipment and platform to 6 feet 9 inches.  There will be four equipment boxes which will be placed 5 feet from the parapet wall.

 

Ms. Lew explained that both the Greater Avenues and East Central Community Councils reviewed the proposal and both were not opposed.  Ms. Lew added that the Planning Staff recommends approval with the findings and conditions as outlined in the Staff Report.

 

THEREFORE, Mr. Wheelwright approved the conditional use to install a wireless telecommunications facility at 40 South 900 East.

 

Mr. Wheelwright noted that a permit may be obtained after the appeal period expires.

 

ZENITH AVENUE Minor Subdivision, an amendment of Lots 7 and 8 of the Hillcrest 2nd Addition Subdivision by Mark Lundgren from Community Development Corporation of Utah (CDC) requesting a two-lot subdivision separating two existing houses for one lot each located at 1103 and 1115 East Zenith Avenue (2905 South).  The property consists of 0.243 acre and is zoned R-1/7000.  (Staff - Jackie Gasparik)

Mark Lundgren, representing the Community Development Corporation of Utah, was present.

 

Mr. Mikolash reviewed the departmental comments explaining that the Planning Staff preformed an on-site visit on April 30, 2002.  The Transportation Division recommends approval provided the existing fence on the property line is relocated or remove, and a new approach and driveway with a 3-to-1 taper is installed for Lot 2.  The plans submitted show a 2-to-1 taper.  The Engineering Division requires sidewalk repair or replacement on one uneven sidewalk joint along 1100 East and five along Zenith Avenue.  Engineering requires a permit to work in the public way prior to installing public way improvements.  The Public Utilities Department requires plans to be submitted for all new construction, a new water meter for Lot 2, and a fire flow test by the Fire Department.  The sewer lateral for the existing home on Lot 1 runs through the new lot (Lot 2) and the easement for this line should be widened.  Mr. Mikolash advised Mr. Lundgren to contact Peggy Garcia in Public Utilities regarding the easement.  All new sewer and water connections and the new meter require permits from Public Utilities.  The Fire Department commented that all new construction will require review and approval.  The Planning Staff recommends approval subject to meeting all review comments of the City departments and division, and submitting a final plat application.  Mr. Mikolash noted that the Planning Staff will need four 11 x 17 copies of the plan and a filing fee for the final plat application.

 

Mr. Lundgren agreed to meet recommendations of the City departments and divisions.

 

Regarding the easement, Mr. Wheelwright noted that the sewer lateral is eight feet deep and the easement must be wide enough to accommodate the trench width if the lateral needs replacement.  Mr. Wheelwright also noted that the reduction of required yard areas was approved by the Zoning Administrator as recorded in Case #ZA 1357.  The reduced yard areas were approved because the single-family dwellings already exist.

 

THEREFORE, Mr. Wheelwright approved the subdivision amendment.

 

ALFRED GARDENS Minor Subdivision, an amendment of Lots 2, 3 and a portion of Lot 4, Block 2 of the Broadway Addition by Lorin Stott requesting subdivision of a lot with an existing home that will remain on one lot and creating a new lot for a future single-family home located at 1903 South Edison Street (140 East).  The property consists of 0.239 acre and is zoned R-1/5000.  (Staff - Jackie Gasparik)

Mr. Mikolash reviewed the departmental comments explaining that Planning Staff preformed an on-site visit on April 30, 2002.  The Transportation Division reviewed and approved the project with the driveway depth of 17 feet 4 inches.  The requirement is 18 feet from the sidewalk to the front of the dwelling.  A new drive approach and driveway are required for the west lot, and the east lot that is undeveloped will require full compliance with City standards for vehicular access.  The Engineering Division requires repairing or replacing six uneven sidewalk joints along Westminster Avenue and five along Edison Street.  Two sidewalk panels on Westminster Avenue are severely displaced by tree roots and must be replaced.  Prior to cutting tree roots, the Stotts must contact Bill Rutherford who is the Salt Lake City Urban Forester.  The Engineering Division also requires permits to work in the public way prior to installing any public way improvements, and the final plat must comply with the requirements as indicated on the attached plat checklist.  Mr. Mikolash said that he will provide the Stotts with the checklist.  Public Utilities requires all new construction to conform with State, County, City and Public Utilities standards, and a utility plan must be submitted for new construction showing water, fire and sewer utility connections.  Mr. Mikolash noted that the Stotts may not need to submit the plan if they sell the lot undeveloped, but department and division comments need to be transferred to the new property owner.  Fire Department approval is required prior to Public Utilities approval.  Public Utilities further commented that water and sewer mains are located within the park strip between the sidewalk and street curb on the north side of Westminster Avenue and no new trees should be planted in this area.  Any new sewer and/or water connections will need to be coordinated with Peggy Garcia at the Public Utilities Department.

 

The Applicants and Staff discussed garage design and access options.  Mr. Mikolash explained that an alley way exists to the east of the property.  It is preferred that the existing approach and alley be used to access the property because it eliminates an approach along Edison Street.  It is noted that a portion of the alley is to be included in the computation of the required yard area and setback.  Mr. Stott said that he received a letter from the City stating that they may not use the property, but it can be used as part of the computation of the required 5,000 square feet of yard area and setbacks of the dwelling.  Mr. Mikolash is to verify with Larry Butcher, Zoning Administrator, whether or not a portion of the alley can be considered as required yard area and setback.

 

THEREFORE, Mr. Wheelwright approved the subdivision amendment.

 

Mr. Wheelwright noted that the Applicants may begin the process for final plat approval.  Responding to questions by the Applicants, Mr. Mikolash explained that a certified address may be obtained from Engineering upon application of building permits for new construction.  The fee for the final plat application is $300 plus $75 per lot.
