SALT LAKE CITY ORDINANCE
No. 89 of 2012
(Amending the North Temple Area Plan and Salt Lake City Zoning Map
pertaining to property located at 549 West 400 North Street)
An ordinance amending the Future Land Use Map of the North Temple Area Plan and amending the Salt Lake City Zoning Map pertaining to property located at 549 West 400 North Street pursuant to Petition Nos. PLNPCM2012-00254 and PLNPCM2012-00255.
WHEREAS, the Salt Lake City Planning Commission (“planning commission”) held a public hearing on July 11, 2012 on an application submitted by Signature Books, Inc. (“Applicant”) to amend the North Temple Area Plan and the Salt Lake City Zoning Map pertaining to property located at 549 West 400 North Street (“Property”) to change the zoning from Special Development Pattern Residential (SR-1A) to Transit Station Area Urban Center and to amend the Future Land Use Map of the North Temple Area Plan concerning said Property from Transit Station Area Stable to Transit Station Area Transition pursuant to Petition Nos. PLNPCM2012-00254 and PLNPCM2012-00255; and
WHEREAS, at its July 11, 2012 meeting, the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council (“city council”) on said applications, subject to the condition that, in order to preserve the continuity of the area plan and zoning plan, that this application only be approved if a pending zoning amendment application for adjacent property is also approved; and
WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance is in the city’s best interests.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amending the North Temple Area Plan. That the Future Land Use Map of the North Temple Area Plan shall be and hereby is amended to change the designated future land use of the Property located at 549 West 400 North Street (Tax ID No. 08-36-155-013), and which Property is more particularly described in Exhibit “A” attached hereto, from Transit Station Area Stable to Transit Station Area Transition, subject to the condition set forth in Section 3 herein.
SECTION 2. Amending the Zoning Map. That the Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to reflect that the Property described in Section 1 above, shall be and hereby is re-zoned from Special Development Pattern Residential (SR-1A) to Transit Station Area Urban Center, subject to the condition set forth in Section 3 herein.
SECTION 3. Condition. That the approval of the applications identified herein for amendments to the North Temple Area Plan and the Salt Lake City Zoning Map be conditioned upon the city council first approving the zoning map amendment for an adjacent parcel (Petition No. PLNPCM2011-00665) in order to preserve the continuity of zoning for the subject area.
SECTION 4. Effective Date. This ordinance shall become effective on the date of its first publication. The City Recorder is instructed to not publish or record this ordinance until the condition identified above has been met, as certified by the city’s planning director.
SECTION 5. Time. If the condition set forth herein is not satisfied within one year from the adoption of this ordinance, this ordinance shall become null and void.
