SALT LAKE CITY ORDINANCE
No. of 73 2016
(Amending Chapter 18.98, Impact Fees, to extend the temporary suspension of collection of certain impact fees)
WHEREAS, the City is in the process of updating its Impact Fee Facilities Plan (“IFFP”) to reconsider the types and amounts of impact fees charged for new development within the City; and
WHEREAS, on October 20, 2015, the City Council adopted a temporary suspension of collection of impact fees, which expires on November 2, 2016; and
WHEREAS, until the City implements the new IFFP and new impact fees go into effect, the City Council finds that it is in the City’s best interest to continue the suspension collection of park, fire, roadway facilities, and police impact fees for all new development in the City; and
WHEREAS, the City Council finds that adoption of this ordinance reasonably furthers the health, safety, and general welfare of the, citizens of Salt Lake City.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amending Salt Lake City Code 18.98.005, Suspension of Collection. Section 18.98.005, Suspension of Collection, Salt Lake City Code is hereby deleted in its entirety and replaced with the following:
18.98.005: SUSPENSION OF COLLECTION:
A. From November 2, 2016 to the date the impact fee enactment enacting new impact fees becomes effective, no park, fire, roadway facilities, or police impact fees will be collected as a condition of issuance of a building permit on any new development in the City. In the event of a conflict between this section and any other provision of City Code 18.98, this section shall prevail.
SECTION 2. Effective Date. This ordinance shall take effect immediately upon adoption.
