SALT LAKE CITY ORDINANCE

No. 72 of 2013

 

(Closing a portion of city-owned alley along the north and south edges of the

Sugar House Streetcar Greenway Corridor between 800 and 900 East)

 

An ordinance closing a portion of city-owned alley situated midblock between Wilmington Avenue and Simpson Avenue and between 800 East and 900 East Streets, pursuant to Petition No. PLNPCM2013-00119.

 

WHEREAS, the Salt Lake City Planning Commission held a public hearing on May 22, 2013 to consider a request made by Ryan McFarland of Salt Lake City Corporation (“Applicant”) to close and abandon a portion of city-owned alley situated midblock between Wilmington Avenue and Simpson Avenue and between 800 East and 900 East Streets (Petition No. PLNPCM2013-00119) in order to complete trails, landscaping and other improvements related to the Sugar House streetcar and Parley’s Trail; and

      WHEREAS, at its May 22, 2013 hearing, the planning commission voted in favor of forwarding a positive recommendation on said petition to the Salt Lake City Council; and

      WHEREAS, the city council finds after public hearings that keeping the portion of the alley described below open for vehicular access is not necessary for use by the public, and that closing the portion of the subject alley to vehicular access will accommodate other important public purposes and will not be adverse to the general public’s interest; and

      WHEREAS, after a hearing before the city council, the city council has determined that adopting this ordinance is in the city’s best interests.

      NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

      SECTION 1.  Closing a portion of city-owned alley.  That a portion of city-owned alley situated midblock between Wilmington Avenue and Simpson Avenue and between 800 East and 900 East Streets, which is the subject of Petition No. PLNPCM2013-00119, and which is more particularly described on Exhibit “A” attached hereto, hereby is, closed to vehicular access. 

      SECTION 2.  Effective Date.  This Ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder.
