SALT LAKE CITY ORDINANCE
No. 63 of 2014
(Amending the City’s Ordinances Regarding Carriage Businesses)
An ordinance amending Section 2.07.020 of the Salt Lake City Code, amending Chapter 5.37 of the Salt Lake City Code, and repealing Chapter 2.15 of the Salt Lake City Code.
WHEREAS, Salt Lake City Corporation (the “City”) presently has ordinances providing for the establishment of a horsedrawn carriage committee and addressing the regulation of carriage businesses within the City; and
WHEREAS, there are presently no licensed carriage businesses operating within the City boundaries; and
WHEREAS, the system of roads within Salt Lake City carries large volumes of vehicular traffic, and
WHEREAS, the intermingling of slow-moving, commercially operated animal-drawn carriages or vehicles with heavy city traffic has led to accidents and other incidents that have resulted in property damage and personal injury, or have endangered the health and safety of automobile and carriage passengers, pedestrians, and animals; and
WHEREAS, the waste from animals creates sanitation challenges on the City streets; and
WHEREAS, Salt Lake City often is subject to weather conditions, including but not limited to accumulated snow, black ice, and extreme temperatures, that render travel by animal-drawn carriage dangerous for carriage passengers, automobile passengers, pedestrians, and animals; and
WHEREAS, the City Council finds that the ordinance changes set forth herein reasonably further the health, safety, and general welfare of the citizens of Salt Lake City.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Section 2.07.020 of the Salt Lake City Code is hereby amended to read as follows:
2.07.020: CITY BOARDS AND COMMISSIONS NAMED:
For the purpose of this chapter the term “city board” or “board” means the following city boards, commissions, councils, and committees:

SECTION 2. Chapter 5.37 of the Salt Lake City Code is hereby amended to read as follows:
CHAPTER 5.37
ANIMAL-DRAWN CARRIAGES
5.37.010: DEFINITIONS
5.37.020: ANIMAL-DRAWN CARRIAGES PROHIBITED
5.37.010: DEFINITIONS
As used in this Chapter, the following terms shall be defined as follows:
ANIMALS: Any and all types of livestock, horses, dogs and other nonhuman creatures, both domestic and wild, male and female, singular and plural.
ANIMAL-DRAWN CARRIAGE: Any device in, upon, or by which a person may be transported or drawn upon a public street and that is designed to be drawn by animals.
PERSON: Any individual, corporation, partnership, association, club, or any other legal entity.
PUBLIC STREET: Any public street, road, alley, right-of-way, or sidewalk situated in a public right-of–way, located inside the city boundaries.
5.37.020: ANIMAL-DRAWN CARRIAGES FOR HIRE PROHIBITED
A. It shall be unlawful for any person to operate or cause to be operated an animal-drawn carriage for hire upon any public street within the city, or to operate for hire any similar apparatus that is powered or propelled by an animal.
B. The prohibition set forth in subsection A shall not apply to the use of an animal-drawn carriage in connection with a special event or free expression activity held pursuant to Chapter 3.50 of the Salt Lake City Code.
SECTION 3. Chapter 2.15 of the Salt Lake City Code is hereby repealed in its entirety.
SECTION 4. This ordinance shall become effective on the date of its first publication.
