SALT LAKE CITY ORDINANCE

No. 60 of 2012

 

(Amending the Central Community Master Plan and zoning map pertaining to properties located between 1015 and 1035 South 200 West Street and at 1068 South Jefferson Street)

 

An ordinance amending the Future Land Use Map of the Central Community Master Plan and amending the zoning map pertaining to five parcels located between 1015 and 1035 South 200 West Street and one at 1068 South Jefferson Street pursuant to Petition Nos. PLNPCM2011-00658 and PLNPCM2011-00659.

 

     WHEREAS, the Salt Lake City Planning Commission (“planning commission”) held a public hearing on February 22, 2012 on an application submitted by Capitol Center Properties (“Applicant”) to amend the Central Community Master Plan and zoning map pertaining to five parcels located between 1015 and 1035 South 200 West Street and one at 1068 South Jefferson Street (“Properties”) to change the zoning from Moderate Density Multi-Family Residential (RMF-35) to Residential/Mixed Use (R-MU) and to amend the Future Land Use Map of the Central Community Master Plan concerning said Properties from Medium Density Residential to Medium Residential/Mixed Use pursuant to Petition Nos. PLNPCM2011-00658 and PLNPCM2011-00659; and

     WHEREAS, at its February 22, 2012 meeting, the planning commission voted in favor of forwarding a negative recommendation to the Salt Lake City Council (“city council”) on said applications; and

     WHEREAS, after a public hearing on this matter the city council has rejected the planning commission’s recommendation and has determined that adopting this ordinance is in the city’s best interests.

     NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1.     Amending the Central Community Master Plan.  That the Future Land Use Map of the Central Community Master Plan shall be and hereby is amended to change the designated future land use of five parcels located between 1015 and 1035 South 200 West Street and one at 1068 South Jefferson Street (Tax ID Nos. 15-12-408-001, 15-12-408-002, 15-12-408-003, 15-12-408-004, 15-12-408-005, and 15-12-408-021), and which properties are more particularly described in Exhibit “A” attached hereto, from Medium Density Residential to Medium Residential/Mixed Use.

SECTION 2. Amending the Zoning Map.  The Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to reflect that the Property described in Section 1 above, shall be and hereby is re-zoned from Moderate Density Multi-Family Residential (RMF-35) to Residential/Mixed Use (R-MU).

SECTION 3. Condition.  Approval of the amendments described in Sections 1 and 2 above is conditioned upon satisfaction of condition that Applicant enter into a development agreement with the city that:

a. Limits building heights on the subject Properties to seventy-five (75) feet;

b. Requires compatibility for pedestrian and bicycle access;

c. Requires buildings to be oriented in a manner that is compatible with the neighborhood; and

d. Runs with the land.

The Applicant shall work with the Salt Lake City Planning Division to develop specific terms to be included in the development agreement, consistent with this ordinance and city council’s expressed intent.  The Salt Lake City Mayor or his designee shall execute the development agreement on behalf of the city, provided that the terms therein are consistent with this ordinance and the city council’s expressed intent.

SECTION 4. Effective Date.  This ordinance shall become effective on the date of its first publication.  The City Recorder is instructed to not publish or record this ordinance until the conditions identified above have been met, as certified by the city’s planning director. 

SECTION 5. Time.  If the conditions set forth herein are not satisfied within one year from the adoption of this ordinance, it shall become null and void.
