SALT LAKE CITY ORDINANCE
No. 57 of 2013
(An ordinance amending section 21A.32.140 of the
Salt Lake City Code concerning community gardens in the Open Space (OS) Zone)
An ordinance amending section 21A.32.140 of the Salt Lake City Code pursuant to Petition No. PLNPCM2012-00032 to allow community gardens in open space zoning districts.
WHEREAS, the Salt Lake City Planning Commission (“planning commission”) held a public hearing on April 11, 2012 to consider a request made by Salt Lake City Mayor Ralph Becker (Petition No. PLNPCM2012-00032) to amend section 21A.32.140 (Zoning: Special Purpose Districts: Table of Permitted and Conditional Uses for Special Purpose Districts) of the Salt Lake City Code to allow community gardens in open space zoning districts; and
WHEREAS, at its April 11, 2012 hearing, the planning commission voted to transmit a positive recommendation to the Salt Lake City Council (“city council”) on said application; and
WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance is in the city’s best interests.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amending text of Salt Lake City Code section 21A.32.140 That section 21A.32.140 of the Salt Lake City Code (Zoning: Special Purpose Districts: Table of Permitted and Conditional Uses for Special Purpose Districts), shall be, and hereby is, amended in part to add “Community gardens (as defined in chapter 21A.62 of this title)” as a recognized subcategory in that table under the “Residential” use category, to add the appropriate designation of such use in certain zoning districts as conditional or permitted, and to add qualifying provision number 14 as those amendments are shown below. The codifier is instructed to only add the new text identified herein to section 21A.32.140 and leave the remainder of that table undisturbed as part of this amendment.

14. Community gardens are only allowed in the following locations: 1850 S. 700 E., Dilworth Elementary (1985 S. 2100 E.), Warm Springs Park (1020 N. Beck St), Stratford Park (2635 S. Preston St), 1700 S. 700 E., Cortez Water (North of the Capitol), 2850 S. Claybourne Avenue (1300 E. Eastside), and Popperton Park (360 N. 1400 E.), and are subject to the requirements in section 21A.34.130 Riparian Corridor Overlay District.
SECTION 2. Intent to Revisit. The locations identified in Section 1 above as appropriate for community gardens in the OS zoning district are areas where the city council has determined that such use is appropriate without further study. The city council believes that community garden use may be appropriate in other locations within the OS zoning district, but believes that additional study and input from relevant city departments and advisory boards as to development of specific criteria for allowing such use in additional areas of the OS zoning district will allow for better policy implementation. To that end, the city council intends to revisit whether community gardens should be allowed in other locations within the OS zoning district and do so within the scope of the planning commission’s recommendation on this ordinance.
SECTION 3. Effective Date. This ordinance shall become effective on the date of its first publication.
