SALT LAKE CITY ORDINANCE

No. 56 of 2013

(Closing a portion of city-owned alley located adjacent to the Glendale Library Branch property at 1365 South Concord Street)

 

An ordinance closing a portion of city-owned alley adjacent to the Glendale Library Branch property, which alley is situated midblock between Concord Street and 1200 West Street and between California Avenue and 1400 South Street, pursuant to Petition No. PLNPCM2013-00172.

 

WHEREAS, the Salt Lake City Planning Commission held a public hearing on June 12, 2013 to consider a request made by Duran Lucas of Salt Lake City Corporation (“Applicant”) to close a portion of unused, city-owned alley to vehicular traffic, which alley is situated midblock between Concord Street and 1200 West Street and between California Avenue and 1400 South Street (Petition No. PLNPCM2013-00172) in order to accommodate landscaping and other improvements adjacent to the Glendale Library Branch property; and

      WHEREAS, at its June 12, 2013 hearing, the planning commission voted in favor of forwarding a positive recommendation on said petition to the Salt Lake City Council; and

      WHEREAS, the city council finds after public hearings that keeping the portion of the alley described below open for vehicular access is not necessary for use by the public, and that closing the portion of the subject alley to vehicular access will accommodate other important public purposes and will not be adverse to the general public’s interest; and

      WHEREAS, after a hearing before the city council, the city council has determined that adopting this ordinance is in the city’s best interests.

      NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

      SECTION 1.  Closing a portion of city-owned alley.  That a portion of city-owned alley situated midblock between Concord Street and 1200 West Street and between California Avenue and 1400 South Street, which is the subject of Petition No. PLNPCM2013-00172, and which is more particularly described on Exhibit “A” attached hereto, hereby is, closed to vehicular access. 

      SECTION 2.  Effective Date.  This Ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. 

      Passed by the City Council of Salt Lake City, Utah this 24th day of September, 2013.
