SALT LAKE CITY ORDINANCE
No. 54 of 2016
(Amending the zoning of properties located at 2036 South and 2046 South 1300 East Street
from RO (Residential Office) to CB (Community Business))
An ordinance amending the zoning of properties located at 2036 South and 2046 South 1300 East Street from RO (Residential Office) zoning to CB (Community Business) zoning pursuant to Petition No. PLNPCM2015-00050.
WHEREAS, the applicant, Gerry Tulley (“Applicant”) represents the potential purchaser of properties located at 2036 South and 2046 South 1300 East Street (Tax Id No. 16-17-479-043 and No. 16-17-479-044) (the “Properties”); and
WHEREAS, the Applicant, with the property owner’s permission, seeks to change the zoning of the Properties to CB (Community Business) in order to accommodate a proposed development of the Properties; and
WHEREAS, the Salt Lake City Planning Commission held a public hearing on May 27, 2015 on Applicant’s petition (Petition No. PLNPCM2015-00050) to amend the zoning of the Properties; and
WHEREAS, at its May 27, 2015 meeting, the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council to rezone the property located at 2046 South 1300 East Street, but also voted to forward a negative recommendation to rezone the property located at 2036 South 1300 East Street; and
WHEREAS, notwithstanding the planning commission recommendation for the 2036 South 1300 East Street parcel, the city council finds that rezoning both parcels is appropriate; and
WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance is in the city’s best interests.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amending the Zoning of the Properties. That the zoning of the Properties located at 2036 South and 2046 South 1300 East Street (Tax Id Nos. 16-17-479-043 and 16-17-479-044), and which are more particularly described on Exhibit “A” attached hereto, shall be and hereby are amended from RO (Residential Office) zoning district to CB (Community Business) zoning district.
SECTION 2. Conditions. The zoning map amendment that is the subject of Petition No. PLNPCM2015-00050 described herein is conditioned upon Applicant entering into a development agreement with Salt Lake City Corporation to be recorded against the Properties that requires Applicant to incorporate the following design elements into the site:
a) Two building entrances shall be provided, with one entrance located at southeastern corner of the building;
b) Window glazing shall be provided in compliance with the City Zoning Code for the zoning district;
c) Public sidewalks shall be widened to a maximum of 10 feet where possible;
d) No more than one driveway shall be allowed along 2100 South;
e) Pick-up/drop-off window shall be allowed, subject to limitation on driveways along 2100 South;
f) No more than 44 off-street parking spaces shall be provided on site;
g) The street tree planting plan shall comply with the City Forrester’s recommendations (including, without limitation, locating street trees behind the sidewalk along 1300 East);
h) A covered waiting area for bus riders and at least one, weather-protected bicycle rack shall be provided on site; and
i) Enhanced landscape buffers shall be provided adjacent to the parking lot, with lower fencing and shrubs along the western edge of the parking lot near the public alley and a buffer along 1300 East with maximum mounding height of 3 feet.
SECTION 4. Effective Date. This Ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The city recorder is instructed not to publish or record this ordinance until the condition identified above has been met as acknowledged by the director of the Salt Lake City Planning Division.
SECTION 5. Time. If the condition identified above has not been met within one year after adoption, this ordinance shall become null and void. The city council may, for good cause shown, by resolution, extend the time period for satisfying the condition identified above.
