No. 54 of 2015
(Amending the zoning map pertaining to properties located at 360, 362, 364, 366, 376, 412, 417, and 435 South 900 West Street; 841, 843, 848, 852, 857, 858, 859, 864, 865, and 877 West 400 South Street; 866 West Pacific Avenue; 869 West 300 South Street; 321, 331, 365, and 371 South 870 West Street, to rezone said properties from RMF-35 (Moderate Density Multi-Family Residential) and CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use))
An ordinance amending the zoning map pertaining to properties located at 360, 362, 364, 366, 376, 412, 417, and 435 South 900 West Street; 841, 843, 848, 852, 857, 858, 859, 864, 865, and 877 West 400 South Street; 866 West Pacific Avenue; 869 West 300 South Street; 321, 331, 365, and 371 South 870 West Street, to rezone said properties from RMF-35 (Moderate Density Multi-Family Residential) and CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use) pursuant to Petition No. PLNPCM2014-00375.
WHEREAS, the Salt Lake City Planning Commission held a public hearing on March 11, 2015 on a petition initiated by the Salt Lake City Planning Commission (“Applicant”) to amend the city’s zoning map to re-zone properties located at 360, 362, 364, 366, 376, 412, 417, and 435 South 900 West Street; 841, 843, 848, 852, 857, 858, 859, 864, 865, and 877 West 400 South Street; 866 West Pacific Avenue; 869 West 300 South Street; 321, 331, 365, and 371 South 870 West Street, to rezone said properties from RMF-35 (Moderate Density Multi-Family Residential) and CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use) pursuant to Petition No. PLNPCM2014-00375; and
WHEREAS, at its March 11, 2015 meeting, the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council on said application to; and
WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance is in the city’s best interests.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amending the Zoning Map. The Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended as follows:
a. That the property located at 360 South 900 West Street (Tax ID No. 15-02-402-028), and more particularly described on Exhibit “A” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
b. That the property located at 362 South 900 West Street (Tax ID No. 15-02-402-029), and more particularly described on Exhibit “B” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
c. That the property located at 364 South 900 West Street (Tax ID No. 15-02-402-030), and more particularly described on Exhibit “C” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
d. That the property located at 366 South 900 West Street (Tax ID No. 15-02-402-031), and more particularly described on Exhibit “D” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
e. That the property located at 376 South 900 West Street (Tax ID No. 15-02-402-032), and more particularly described on Exhibit “E” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
f. That the property located at 412 South 900 West Street (Tax ID No. 15-02-405-035), and more particularly described on Exhibit “F” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
g. That the property located at 417 South 900 West Street (Tax ID No. 15-02-406-015), and more particularly described on Exhibit “G” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
h. That the property located at 435 South 900 West Street (Tax ID No. 15-02-406-009), and more particularly described on Exhibit “H” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
i. That the property located at 841 West 400 South Street (Tax ID No. 15-02-406-006), and more particularly described on Exhibit “I” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
j. That the property located at 843 West 400 South Street (Tax ID No. 15-02-406-005), and more particularly described on Exhibit “J” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
k. That the property located at 848 West 400 South Street (Tax ID No. 15-02-403-018), and more particularly described on Exhibit “K” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
l. That the property located at 852 West 400 South Street (Tax ID No. 15-02-403-017), and more particularly described on Exhibit “L” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
m. That the property located at 857 West 400 South Street (Tax ID No. 15-02-406-004), and more particularly described on Exhibit “M” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
n. That the property located at 858 West 400 South Street (Tax ID No. 15-02-403-016), and more particularly described on Exhibit “N” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
o. That the property located at 859 West 400 South Street (Tax ID No. 15-02-406-003), and more particularly described on Exhibit “O” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
p. That the property located at 865 West 400 South Street (Tax ID No. 15-02-406-002), and more particularly described on Exhibit “P” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
q. That the property located at 877 West 400 South Street (Tax ID No. 15-02-406-001), and more particularly described on Exhibit “Q” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
r. That the property located at 866 West Pacific Avenue (Tax ID No. 15-02-406-010), and more particularly described on Exhibit “R” attached hereto, shall be and hereby is re-zoned from CN (Neighborhood Commercial) to R-MU-35 (Residential/Mixed Use); and
s. That the property located at 864 West 400 South Street (Tax ID No. 15-02-403-011), and more particularly described on Exhibit “S” attached hereto, shall be and hereby is re-zoned from RMF-35 (Moderate Density Multi-Family Residential) to R-MU-35 (Residential/Mixed Use); and
t. That the property located at 869 West 300 South Street (Tax ID No. 15-02-258-005), and more particularly described on Exhibit “T” attached hereto, shall be and hereby is re-zoned from RMF-35 (Moderate Density Multi-Family Residential) to R-MU-35 (Residential/Mixed Use); and
u. That the property located at 321 South 870 West Street (Tax ID No. 15-02-403-012), and more particularly described on Exhibit “U” attached hereto, shall be and hereby is re-zoned from RMF-35 (Moderate Density Multi-Family Residential) to R-MU-35 (Residential/Mixed Use); and
v. That the property located at 331 South 870 West Street (Tax ID No. 15-02-403-013), and more particularly described on Exhibit “V” attached hereto, shall be and hereby is re-zoned from RMF-35 (Moderate Density Multi-Family Residential) to R-MU-35 (Residential/Mixed Use); and
w. That the property located at 365 South 870 West Street (Tax ID No. 15-02-403-014), and more particularly described on Exhibit “W” attached hereto, shall be and hereby is re-zoned from RMF-35 (Moderate Density Multi-Family Residential) to R-MU-35 (Residential/Mixed Use); and
x. That the property located at 371 South 870 West Street (Tax ID No. 15-02-403-015), and more particularly described on Exhibit “X” attached hereto, shall be and hereby is re-zoned from RMF-35 (Moderate Density Multi-Family Residential) to R-MU-35 (Residential/Mixed Use).
SECTION 2. Effective Date. This ordinance shall become effective on the date of its first publication.
