SALT LAKE CITY ORDINANCE
No. 52 of 2018
(Adjusting the mutual boundary between Salt Lake City and the City of South Salt Lake)
An ordinance adjusting the mutual municipal boundary between Salt Lake City and the City of South Salt Lake to transfer a parcel located at 2508 South 500 East Street from Salt Lake City jurisdictional territory to City of South Salt Lake jurisdictional territory.
WHEREAS, the Salt Lake City Planning Commission held a public hearing on September 27, 2017 on a request submitted by the City of South Salt Lake to adjust the mutual municipal boundary between Salt Lake City and the City of South Salt Lake to transfer a parcel located at 2508 South 500 East Street from Salt Lake City jurisdictional territory to City of South Salt Lake jurisdictional territory; and
WHEREAS, the parcel located at 2508 South 500 East Street is owned by the City of South Salt Lake and is intended to be used for public recreational purposes; and
WHEREAS, at its September 27, 2017 meeting, the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council on said request; and
WHEREAS, no written protest of this boundary adjustment has been filed with the Salt Lake City Recorder by a property owner described in Utah Code Subsection 10-2-419(2)(d); and
WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance is in the city’s best interests.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Adjusting the Municipal Boundary. In accordance with Utah Code Section 10-2-419, the mutual municipal boundary between Salt Lake City and the City of South Salt Lake shall be and hereby is adjusted to transfer the parcel located at 2508 South 500 East Street (Tax ID No. 16-19-407-010) from Salt Lake City’s jurisdictional territory to the City of South Salt Lake jurisdictional territory as shown on the proposed final Salt Lake City Plat, attached hereto as Exhibit “A”.
SECTION 2. Removal From Local Districts and Discontinuance of Municipal Services. The parcel of land subject to this municipal boundary adjustment shall be removed from all local service districts with jurisdictional boundary limits determined by Salt Lake City’s mutual boundaries with the City of South Salt Lake and shall cease to receive all municipal services from Salt Lake City unless such services are provided by interlocal agreement.
SECTION 3. Effective Date. In accordance with Utah Code Subsection 10-2-419(7), this Ordinance shall become effective upon the latter of the dates that each municipality involved in this mutual boundary adjustment have adopted such an ordinance. This Ordinance, along with all applicable materials and information required by Utah Code Section 10-2-425, shall be filed with the Office of the Lieutenant Governor within thirty (30) days of its enactment.
