SALT LAKE CITY ORDINANCE

No. 42 of 2017

 

(Rescinding Ordinance 33 of 2017 and adopting a new Memorandum of Understanding between Salt Lake City Corporation and the American Federation of State, County, and Municipal Employees Local 1004)

 

              An ordinance rescinding Ordinance 33 of 2017 and adopting a new Memorandum of Understanding between Salt Lake City Corporation and the American Federation of State, County, and Municipal Employees Local 1004, representing eligible employees pursuant to the Collective Bargaining and Employee Representation Joint Resolution dated March 22, 2011, which shall become effective on proper ratification and signature.

WHEREAS, the American Federation of State, County, and Municipal Employees Local 1004, representing eligible employees pursuant to the Collective Bargaining and Employee Representation Joint Resolution dated March 22, 2011, and the Mayor, have agreed to a Memorandum of Understanding subject to appropriate ratification by eligible employees and signature of the parties; and

WHEREAS, Section 6 of the Collective Bargaining and Employee Representation Joint Resolution dated March 22, 2011 provides that no collective bargaining Memorandum of Understanding shall be effective until the City Council approves the Memorandum of Understanding, enacts implementing legislation, and appropriates all required funds; and

WHEREAS, the attached Memorandum of Understanding is a two-year agreement effective for fiscal years 2018-2019, and the City Council has appropriated necessary funds required to implement the provisions of the attached Memorandum of Understanding for fiscal year 2018; and

WHEREAS, the City Council approved Ordinance 33 of 2017, the prior Memorandum of Understanding between Salt Lake City Corporation and the American Federation of State, County, and Municipal Employees Local 1004, on June 13, 2017; and

WHEREAS, after further negotiations the Mayor and the American Federation of State, County, and Municipal Employees Local 1004 wish to rescind ordinance #33 of 2017 and adopt the attached Memorandum of Understanding.

Be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1.  PURPOSE.  The purpose of this ordinance is to rescind ordinance #33 of 2017, and adopt the attached Memorandum of Understanding, which shall become effective on appropriate ratification by the eligible employees and on signature of the Mayor and the American Federation of State, County, and Municipal Employees Local 1004. The only change is to Article 10 - Personnel Files, as follows:

ARTICLE 10 – PERSONNEL FILES

 

Departments will provide a copy of all written disciplinary actions to Human Resources within thirty (30) calendar days of the date of the discipline. Human Resources will maintain the documents in a secure, centralized location. Any eligible employee has the right to review his or her files and to request that a written warning be purged after two years, provided the written warning was not EEO or Violence in the Workplace related.

 

SECTION 2.  The attached Memorandum of Understanding between the City and the American Federation of State, County, and Municipal Employees Local 1004 is hereby approved.

SECTION 3.  AUTHORIZATION.  The Mayor of Salt Lake City, Utah is hereby authorized to act in accordance with the terms and conditions of the attached Memorandum of Understanding when it is properly ratified and executed.

SECTION 4.  EFFECTIVE DATE.  This Ordinance shall be deemed effective on July 2, 2017.
