SALT LAKE CITY ORDINANCE
No. 3 of 2017
(Amending Chapter 2.14, Airport Board, and Section 16.04.050, Airports.)
An ordinance amending various sections of Chapter 2.14 (Airport Board) and amending 16.04.050 (Airports) of the Salt Lake City Code.
WHEREAS, the Airport Board is an advisory board for the city’s department of airports, which includes any airports owned by the city, even if outside of the city’s boundaries; and,
WHEREAS, the revised ordinance provides representation on the airport advisory board to any political subdivisions outside the city, which have within their boundaries an airport owned by the city; and,
WHEREAS, certain definitions in city code need to be amended for consistency; and,
WHEREAS, the revised ordinance is in the best interest of the city and the city’s department of airports.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That the following sections of Chapter 2.14 of the Salt Lake City Code, relating to the Airport Board, be, and the same hereby is, amended to read as follows:
In this chapter,
the following definitions apply:
AIRPORT: The city's department of
airports, and all property owned or operated by the City through its department
of airports, including the Salt Lake City International Airport, South Valley
Regional Airport, Tooele Valley Airport, and any other airport owned or operated
by the city.
BOARD: The city airport board.
BOARD MEMBER: A person
appointed by the mayor, with the advice and consent of the council, who is a
duly qualified voting member of the board.
CITY: Salt Lake
City, a municipal corporation of the state.
COUNCIL: The city
council.
DIRECTOR OF AIRPORTS: The city's director of its department of
airports.
EX OFFICIO MEMBER: A duly qualified and nonvoting member of the board.
MAYOR: The duly
elected or appointed, and qualified mayor of the city.
POLITICAL SUBDIVISION: A county or a municipality in the state.
POLITICAL SUBDIVISION REPRESENTATIVE: A voting board member, appointed by the mayor, with the advice and consent of the council. A Political Subdivision Representative must, at the time of appointment, be an elected official of a political subdivision which has within its boundaries an airport owned by the city.
There is created
the city airport board, hereinafter referred to as "board.”
A. The board shall consist of:
a. Nine (9) appointed voting board members, no more than three (3) of whom may reside outside the boundaries of Salt Lake City;
b. One (1) appointed political subdivision representative from each qualifying political subdivision; and,
c. Ex officio members:
i. The mayor, or the mayor’s designee;
ii. Each council member;
iii. The director of airports, or the director’s designee;
iv. The city attorney, or the city attorney’s designee; and
v. The city engineer, or the city engineer’s designee.
All appointments
shall be made for a four (4) year term, consistent with the city’s boards and
commissions ordinance, chapter 2.07 of this title.
SECTION 2. That the following definition of Airport in Section 16.04.050 of the Salt Lake City Code, is amended to read as follows:
“Airport" means
the city’s department of airports, and all property owned or operated by the
City through its department of airports, including the Salt Lake City
International Airport, the Tooele Valley Airport, as they now exist or as may
hereafter be expanded and exist, together with all their appurtenant facilities,
and any other airport owned or operated by the city. A territorial division
thereof may be designated by number.
SECTION 3. That this ordinance shall take effect immediately upon the date of its first publication.
