No. 39 of 2014

(Amending the civil penalty schedule for unauthorized use of streets and similar areas)

An ordinance amending section 12.56.550 of the Salt Lake City Code relating to civil penalties for unauthorized use of streets, parking lots, and other areas.

WHEREAS, specific ordinance provisions in the Salt Lake City Code prohibit certain unauthorized uses of streets, parking lots, and other areas; and

WHEREAS, section 12.56.550 of the Salt Lake City Code describes provides for civil penalties and sets forth specific civil penalties that correspond to certain unauthorized uses of streets, parking lots, and other areas; and

WHEREAS, the civil penalties provided for in section 12.56.550 of the Salt Lake City Code are amended and updated from time to time; and

WHEREAS, the Salt Lake City Council finds the amendments to the civil penalties and associated ordinance language set forth below reasonably further the health, safety, and general welfare of the citizens of Salt Lake City.

NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. That section 12.56.550 of the Salt Lake City Code shall be, and hereby is, amended as follows:

12.56.550: UNAUTHORIZED USE OF STREETS, PARKING LOTS AND OTHER AREAS; PENALTIES:

A. Violation:

1. Any person engaging in the unauthorized use of streets, parking lots or other areas as provided under this chapter, within the city, shall be liable for a civil penalty. Any penalty assessed in subsection B of this section may be in addition to such other penalties as may be provided in this title.

2. "Unauthorized use of streets" means a violation of any restriction or prohibition contained in this chapter or its successor.

B. Civil Penalties: Civil penalties shall be imposed as follows:

Note ^1: A violation of subsection 12.56.440(B) that occurs in a particular location is subject to the same civil penalty would be imposed for a violation of subsection 12.56.440(A) in that same location.

C. Reduction Of Penalties: The civil penalties specified in subsection B of this section shall be subject to the following:

1. Any penalty that is paid within ten (10) days from the date of receipt of notice shall be reduced by the sum of one hundred twenty dollars ($120.00).

2. Any penalty that is paid within twenty (20) days from the date of receipt of notice shall be reduced by the sum of eighty dollars ($80.00).

3. Any penalty that is paid within thirty (30) days from the date of receipt of notice shall be reduced by the sum of forty dollars ($40.00).

D. Receipt Of Notice: As used in this section, "receipt of notice" means the affixing of a notice to the vehicle alleged to have been employed in such unauthorized use, or by delivery of such notice to the owner or driver thereof.

SECTION 2. That this ordinance shall become effective immediately upon publication.
