SALT LAKE CITY ORDINANCE
No. 2 of 2013
(Relocating a public use easement on property located at approximately 1201 East Wilmington Avenue)
An ordinance authorizing the amendment of the Holladay Subdivision plat to relocate a public use easement on property located at approximately 1201 East Wilmington Avenue.
WHEREAS, Utah Code sections 10-9a-608 and 10-9a-609.5 require a municipality’s legislative body to hold a public hearing when a public use easement shown on a subdivision plat is proposed to be altered or vacated; and
WHEREAS, the Redevelopment Agency of Salt Lake City (“Applicant”) has applied to amend the Holladay Subdivision plat (Petition No. PLNSUB2012-00121) to relocate a public use easement recorded on its property located at approximately 1201 East Wilmington Avenue (the “Property”), and which public use easement is depicted on the Holladay Subdivision plat; and
WHEREAS, the proposed relocation of the public use easement on the Property would not result in any net loss of the easement area and would allow beneficial use of both the remainder of the Property and the public use easement; and
WHEREAS, after holding a public hearing on this matter the Salt Lake City Council (“city council”) finds that there is good cause to adopt this ordinance authorizing the relocation of the public use easement described herein and that neither the public interest nor any person will be materially injured by the easement relocation.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Authorizing the Relocation of a Public Use Easement. That the city council authorizes the relocation of the twenty-foot (20’) wide public use easement described as a “PEDESTRIAN AND MAINTENANCE EASEMENT” from the location shown in the Holladay Subdivision plat as recorded in the Office of the Salt Lake County Recorder, to the new location shown in Exhibit “A” hereto (“Holladay Subdivision Amended”), which relocated easement shall be described on said Holladay Subdivision Amended plat as “MAINTENANCE AND PUBLIC PEDESTRIAN/BICYCLE EASEMENT TO PARLEY’S TRAIL”, subject to all other state and local requirements for subdivision amendments.
SECTION 2. Effective Date. This ordinance shall become effective on the date of its first publication or posting.
