SALT LAKE CITY ORDINANCE

No. 19 of 2014

 

(Amending the zoning map pertaining to property located between 5600 West and the

Mountain View Corridor right of way and between 1300 and 2100 South Streets from

Open Space (OS) to Light Manufacturing (M-1))

 

      An ordinance amending the zoning map to re-zone portions of property located between 5600 West and the Mountain View Corridor right of way and between 1300 and 2100 South Streets from Open Space (OS) to Light Manufacturing (M-1) pursuant to Petition No. PLNPCM2013-00767.

 

      WHEREAS, the Salt Lake City Planning Commission held a public hearing on December 11, 2013 on an application submitted by Natomas Meadows, LLC (“Applicant”) on behalf of the State of Utah School and Institutional Trust Lands Administration (“SITLA”) to amend the city’s zoning map to re-zone portions of property located between 5600 West and the Mountain View Corridor right of way and between 1300 and 2100 South Streets (the “Property”) from Open Space (OS) to Light Manufacturing (M-1) pursuant to Petition No. PLNPCM2013-00767; and

      WHEREAS, at its December 11, 2013 meeting, the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council on said application; and

      WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance, subject to the conditions listed herein, is in the city’s best interests.

WHEREAS, to allow development of the Property for the benefit of Applicant and to implement city objectives, Applicant is willing to voluntarily enter into a development agreement with the city as described in Section 2 below.

      NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

      SECTION 1.  Amending the Zoning Map.  The Salt Lake City Zoning Map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to reflect that portions of the Property located between 5600 West and the Mountain View Corridor right of way and between 1300 and 2100 South Streets, and which area to be rezoned  is more particularly described on Exhibit “A” attached hereto, shall be and hereby is re-zoned from Open Space (OS) to Light Manufacturing (M-1), subject to the conditions set forth in Section 2 herein.

SECTION 2.  Approval of the amendments described in Section 1 above is conditioned upon Applicant entering into a development agreement with the city that:

a. Requires Applicant to dedicate to the Utah Department of Transportation a minimum thirty-five (35) foot wide area of Applicant’s Property along 5600 West Street for roadway expansion through the city’s subdivision process;

b. Requires Applicant to install in the Property’s setback area along 5600 West Street

a ten-foot (10’) wide bike trail with a two-foot (2’) minimum landscaping buffer on the side of the bike trail adjacent to 5600 West Street and a three-foot (3’) landscaping buffer along the interior side of the bike trail.  The bike trail and landscaping buffers shall run along the Property’s length of 5600 West Street and shall be installed at such time as Applicant obtains a building permit to construct the first building on the Property;

c. Requires Applicant to install in the Property’s setback area along the north side of the future 1730 South Street a ten-foot (10’) wide bike trail with a two-foot (2’) minimum landscaping buffer on the side of the bike trail adjacent to the future 1730 South Street and a three-foot (3’) landscaping buffer along the interior side of the bike trail.  The bike trail and landscaping buffers shall run along the Property’s length of the future 1730 South Street and shall be installed at such time as Applicant obtains a building permit to build a building on a lot adjoining 1730 South Street;

d. Confirms that the trail and landscaping improvements described above shall be treated as landscaping for purposes of calculating compliance with site landscaping requirements;  and

e. Runs with the land.

Such development agreement shall be executed by the Applicant and by the mayor or his designee.  The executed development agreement shall be recorded against the Property by filing an original thereof with the Salt Lake County Recorder.

SECTION 3.  Effective Date.  This ordinance shall become effective on the date of its first publication.  The city recorder is instructed to not publish or record this ordinance until the conditions identified above have been met, as certified by the city’s planning director. 

SECTION 4. Time.  If the conditions set forth herein are not satisfied within one year from the adoption of this ordinance, it shall become null and void.  The city council, may for good cause shown, extend the deadline provided herein up to one additional year by resolution.
