SALT LAKE CITY ORDINANCE

No. 16 of 2017

 

(Closing and vacating a portion of an unnamed, city owned alley adjacent to

and bisecting property located at 1528 West North Temple Street)

 

          An ordinance closing and vacating a portion of an unnamed, city owned alley adjacent to and bisecting property located at 1528 West North Temple Street pursuant to Petition No. PLNPCM2015-00941.

            WHEREAS, the Salt Lake City Planning Commission held a public hearing on March 23, 2016 on an application submitted by Power Station Investments, LLC (“Applicant”) to close and vacate a portion of an unnamed, city owned alley situated adjacent to and bisecting property located at 1528 West North Temple Street, which portion of alley to be vacated runs north-south along the west side of 1528 West North Temple Street (excluding the northernmost portion) and which bisects that parcel running east-west to its intersection with Cornell Street, pursuant to Petition No. PLNPCM2015-00941; and

            WHEREAS, at its March 23, 2016 meeting, the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council on said application; and

          WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance is in the city’s best interests.

          NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

 

SECTION 1.   Closing and Vacating City-Owned, Unnamed Alleys.  That the city-owned, unnamed alley shown on Exhibit “A”, which is the subject of Petition No. PLNPCM2015-00941, is hereby closed and vacated and declared not presently necessary or available for public use.

          SECTION 2.  Effective Date.  This Ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder.
