SALT LAKE CITY ORDINANCE

No. 16 of 2013

 

(Amending the Capitol Hill Master Plan, zoning map and

zoning ordinance pertaining to the West Capitol Hill Area)

 

An ordinance amending the Future Land Use Map of the Capitol Hill Master Plan and the zoning map pertaining to several properties located in an area bounded by 300 North and 800 North and 400 West and 200 West, and amending certain provisions of the zoning ordinance pursuant to Petition Nos. PLNPCM2012-00462, PLNPCM2012-00463, and PLNPCM2012-00464.

 

      WHEREAS, the Salt Lake City Planning Commission held public hearings on October 10, 2012 and November 14, 2012 on an application submitted by Mayor Ralph Becker (“Applicant”) to amend the Future Land Use Map of the Capitol Hill Master Plan, to amend the zoning map, and to amend the city’s zoning ordinance pertaining to several properties within the West Capitol Hill Area bounded by 300 North and 800 North and 400 West and 200 West pursuant to Petition Nos. PLNPCM2012-00462, PLNPCM2012-00463 and PLNPCM2012-00464; and

      WHEREAS, at its November 14, 2012 meeting, the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council on said applications; and

      WHEREAS, after a public hearing on this matter the city council has determined that adopting this ordinance is in the city’s best interests.

      NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. Amending the Capitol Hill Master Plan

a) That the Future Land Use Map of the Capitol Hill Master Plan shall be and hereby is amended to change the designated future land use of properties located at 356 West Reed Avenue (Tax ID No. 08-25-377-015), 726 North 400 West (Tax ID No.08-25-378-001), 365 West Reed Avenue (Tax ID No. 08-25-378-002), 720 North 400 West (Tax ID No. 08-25-378-009), 664 North 400 West (Tax ID No. 08-25-379-009), 663 North Pugsley Street (Tax ID No. 08-25-379-010), 630 North 400 West (Tax ID No. 08-36-127-001), 638 North 400 West (Tax ID No. 08-36-127-002), 364 West 600 North (Tax ID No. 08-36-127-003), 665 North Pugsley Street (Tax ID No. 08-36-127-004), 657 North Pugsley Street (Tax ID No. 08-36-127-005), 653 North Pugsley Street (Tax ID No. 08-36-127-006), 625 North Pugsley Street (Tax ID No. 08-36-127-009), and 645 North Pugsley Street (Tax ID No. 08-36-127-013), and which properties are more particularly described in Exhibit “A” attached hereto, from their current designations to High Density Mixed Use;

b) That the Future Land Use Map of the Capitol Hill Master Plan shall be and hereby is amended to change the designated future land use of properties located at 457 North 300 West (Tax ID No. 08-36-251-008), 453 North 300 West (Tax ID No. 08-36-251-009), 443 North 300 West (Tax ID No. 08-36-251-010), 437 North 300 West (Tax ID No. 08-36-252-016), 427 North 300 West (Tax ID No. 08-36-252-005), 425 North 300 West (Tax ID No. 08-36-252-007), 415 North 300 West (Tax ID No. 08-36-252-008), 401 North 300 West (Tax ID No. 08-36-252-015), and 312 West 400 North (Tax ID No. 08-36-252-014), and which properties are more particularly described in Exhibit “B” attached hereto, from their current designations to Medium Density Mixed Use; and

c) That the Future Land Use Map of the Capitol Hill Master Plan shall be and hereby is amended to change the designated future land use of property located at 306 North 300 West (Tax ID No. 08-36-402-021), and which property is more particularly described in Exhibit “C” attached hereto, from Medium Density Residential to Medium Density Mixed Use.

SECTION 2.  Amending the Zoning Map

a) That the Salt Lake City Zoning Map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to reflect that the properties described in Section 1(a) above, shall be and hereby are re-zoned from CG General Commercial District to MU Mixed Use District; and

b) That the Salt Lake City Zoning Map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to reflect that properties located at 457 North 300 West (Tax ID No. 08-36-251-008), 453 North 300 West (Tax ID No. 08-36-251-009), 443 North 300 West (Tax ID No. 08-36-251-010), and 437 North 300 West (Tax ID No. 08-36-252-016), and which properties are more particularly described in Exhibit “B” attached hereto, shall be and hereby are re-zoned from RMF-35 Moderate Density Multi-Family Residential District to MU Mixed Use District.

 

SECTION 3.  Amending text of Salt Lake City Code section 21A.32.130.D.  That section 21A.32.130.D of the Salt Lake City Code (Zoning: Special Purpose Districts: MU Mixed Use District: Minimum Lot Area and Width), shall be, and hereby is, amended to read as follows:

Qualifying Provisions:

1. There is no minimum lot area nor lot width required provided:

a. Parking for units shall be rear loaded and accessed from a common drive shared by all units in a particular development;

b. Driveway access shall connect to the public street in a maximum of two locations; and,

c. No garages shall face the primary street and front yard parking shall be strictly prohibited.

 

 

   SECTION 4.  Effective Date.  This ordinance shall become effective on the date of its first publication.
