SALT LAKE CITY ORDINANCE
No. 13 of 2009
(Amending the Zoning Map Concerning Property Located at 1933 South 2000 East)
An ordinance amending the zoning map to change the zoning designation of property located at 1933 South, 2000 East from R-1/7,000 (Single-Family Residential) to I (Institutional), pursuant to Petition No. PLNPCM2009-00074.
WHEREAS, the Salt Lake City Planning Commission (“Planning Commission”) held a public hearing on March 25, 2009 on an application made by the Church of Jesus Christ of Latter-Day Saints (“Applicant”) to amend the Salt Lake City zoning map pertaining to property located at 1933 South, 2000 East (Sidwell Tax ID Nos. 16-15-356-013, 16-15-356-014 and 16-15-356-015) (the “Property”) to change the zoning district designation of the Property from R-1/7,000 (Single Family Residential) to I (Institutional); and
WHEREAS, at its March 25, 2009 meeting, the Planning Commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council (“City Council”) on said application; and
WHEREAS, after a hearing before the City Council, the City Council has determined that the following ordinance is in the best interest of the City.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amending the City’s Zoning Map to re-zone the Property. The Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be and hereby is amended to re-classify the zoning district designation of the Property located at 1933 South, 2000 East, and which is more particularly described on Exhibit “A” attached hereto, from the R-1/7,000 (Single-Family Residential) zoning district to the I (Institutional) zoning district, subject to the condition enumerated below.
SECTION 2. Condition. This ordinance is conditioned upon the execution and recording of a development agreement between the Applicant and the City, which agreement shall be substantially conform to the terms and representations set forth in the letter from the Applicant to the City attached hereto as Exhibit “B.”
SECTION 3. Effective Date. This ordinance shall become effective on the date of its first publication. The City Recorder is instructed not to publish or record this ordinance until the condition identified above has been met, as certified by the City Attorney.
SECTION 4. Time. If the condition set forth herein is not satisfied within one year from the adoption of this ordinance, it shall become null and void.
