SALT LAKE CITY ORDINANCE

No. 91 of 1994

 

(Vacating portions of the Chas. S. Desky Fourth Addition Subdivision Pursuant to Petition No. 400-94-44)

AN ORDINANCE APPROVING THE VACATION OF PORTIONS OF THE CHAS. S. DESKY FOURTH ADDITION SUBDIVISION, AS REQUIRED BY SECTION 10-9-808, UTAH CODE ANNOTATED, PURSUANT TO PETITION NO. 400-94-44.

WHEREAS, Petition No. 400-94-44 was filed with the City by Premium Oil, requesting the City to allow the vacation of portions of the Chas. S. Desky Fourth Addition Subdivision; and

WHEREAS, one hundred percent of the owners of the property within and adjacent to the subdivision have not consented to the amendment; and

WHEREAS, the City Council has held a public hearing after giving the required notices and has reviewed the proposed vacation which has been previously preliminarily approved by the Planning Commission on July 7, 1994; and

WHEREAS, good cause exists for the partial vacation of the plat and the City Council finds neither the public nor any person will be materially injured by the partial vacation;

NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. The City hereby approves the proposed partial vacation to the Chas. S. Desky Fourth Addition Subdivision as conditionally approved by the Planning Commission on July 7, 1994.

SECTION 2. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder.
