(Rezoning property located at the east end of Northvale Way pursuant to Petition No. 400-93-126)
AN ORDINANCE AMENDING SECTION 21.14.020 OF THE SALT LAKE CITY CODE RELATING TO ZONING AND FIXING OF BOUNDARIES OF USE DISTRICTS PURSUANT TO PETITION NO. 400-93-126.
WHEREAS, in response to rezoning petition No. 400-93-126, the City Council of Salt Lake City, Utah has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing and demographic details of the area and the Master Plan as part of its deliberation. Pursuant to these deliberations, the Council has concluded that the proposed change of zoning for the property located at the east end of Northvale Way is appropriate for the development of the community in that area; and
THEREFORE, the City Council of Salt Lake City, Utah hereby adopts the following amendments to the Use District provisions of Title 21.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That the Use District Map, as adopted by Section 21.14.020 of the Salt Lake City Code, relating to the fixing of boundaries of Use Districts, be, and the same hereby is, AMENDED to read as follows:
Sec. 21.14.020. Boundaries of Districts--Use District Map Adopted.
That the following-described parcel of real property in Salt Lake City, Utah presently zoned Preservation “P-l” is hereby rezoned Residential “R-l” with a Foothill Overlay “F-l”, and the Use District Map is amended accordingly:
Beginning at the Northeast Corner of Lot 26 of Northcrest Subdivision Plat “H’, a subdivision located in Section 29, Township 1 North, Range 1 East, Salt Lake Base & Meridian; and running thence N 15°45’08” W 50.00 feet; thence N 01°00’00” E 15.42 feet; thence N 25°30’00” W 125.67 feet; thence N 75°52’28” E 88.62 feet; thence N 44°05’l6” E 110.76 feet; thence N 33°03’20” B 142.38 feet; thence N 83°22’59” E 100.00 feet; thence S 07°26’23” E 180.01 feet; thence N 35°40’37” B 5.37 feet; thence S 54°19’23” E 60.00 feet; thence S 35°40’37” W 20.00 feet to a point of a 28.00 foot radius curve to the left; thence Westerly along the arc of said curve through a central angle of 73°23’54”, 35.87 feet to a point of tangency; thence S 35°40’37” W 15.75 feet to a point of tangency of a 210.00 foot radius curve to the right; thence Westerly along the arc of said curve through a central angle of 08°39’l8”, 31.72 feet; thence S 55°27’20” E 75.12 feet; thence S 16°44’09” E 139.95 feet; thence S 32°52’54” W 52.20 feet; thence S 71°53’22” W 366.65 feet; thence North 197.98 feet to the point of beginning.
Containing 3.66 Acres.
SECTION 2. CONDITION. This ordinance shall not become effective until the Mayor has certified that a subdivision plat showing the property to be rezoned and the dedications to the City, approved by the Council, has been approved.
SECTION 3. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder. The City Recorder is instructed to not record or publish this ordinance until the Mayor has certified that the condition specified in Section 2 above has been met. In the event that the condition has not been met within one year from the date of this ordinance the Mayor may extend the time for performance by an additional year. If the condition has not been met within the time permitted by this ordinance the City Recorder is instructed to not record or publish the ordinance, which shall become null, void and of no effect.
