SALT LAKE CITY ORDINANCE

No. 73 of 1994

 

(Closing a portion of an east/west alley adjacent to 208 East 800 South pursuant to Petition No. 400-94-65)

AN ORDINANCE CLOSING A PORTION OF AN EAST/WEST ALLEY ADJACENT TO 208 EAST 800 SOUTH PURSUANT TO PETITION NO. 400-94-65.

WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City’s interests in the alley described below is not necessary for use by the public as an alley and that closure of said alley will not be adverse to the general public’s interest nor divest the City of title to the property without a subsequent conveyance for appraised value.

NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. That a portion of an east-west alley adjacent to 208 East 800 South, which is the subject of Petition No. 400-94-65, and which is more particularly described below, be, and the same hereby is, CLOSED and declared no longer to be needed or available for use as an alley the title remaining with the City until a subsequent sale for appraised value.

Said alley is more particularly described as follows:

Beginning at a point that is N00°02’06”W 16.5 feet from the Southwest corner of Lot 5, Block 1, Plt, 1, of the Official Survey of Plat A, Salt Lake City Survey and is on the West line of Lot 5, Block 1; thence N00°02’06”W 16.5 feet along the West line of Block 1; thence N89°56’54”E 140.5 feet; thence S00°02’06”E 16.5 feet thence S89°56’54”W 140.5 feet to the point of beginning, contains 2318.25 square feet more or less.

SECTION 2. RESERVATIONS AND DISCLAIMERS. The above closure is expressly made SUBJECT TO all existing rights-of-way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City’s water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights-of-way or easements of private third parties.

SECTION 3. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder.
