SALT LAKE CITY ORDINANCE
No. 66 of 1995
(Closing a portion of Swaner Road at approximately 1321 South pursuant to Petition No. 400-94-42)
AN ORDINANCE CLOSING A PORTION OF SWANER ROAD AT APPROXIMATELY 1321 SOUTH, PURSUANT TO PETITION NO. 400-94-42.
WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City’s interest in the public street described below is not necessary for use by the public as a street and that closure of said street will not be adverse to the general public’s interest nor divest the City of title to the property without subsequent documents of transfer.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That a portion of Swaner Road at approximately 1321 South, which is the subject of Petition No. 400-94-42 and which is more particularly described below, be, and the same hereby is, CLOSED and declared no longer to be needed or available for use as a public street, with the title remaining with the City until subsequent sale for market value.
Said street is more particularly described as follows:
Beginning at a point on a 93.05 foot radius curve, said point being North 00°04’04’ West, 210.001 feet and South 89°55’56’ West, 63.321 feet from a Salt Lake County P.1. Monument, said point also being North, 480.702 feet; East, 1997.730 feet from the South Quarter Corner of Section 9, Township 1 South, Range 1 West, Salt Lake Base and Meridian; and running thence along said 93.05 radius curve to the left, 83.20 feet through a central angle of 51°13’56° (chord bears North 5100714411 West, 80.458 feet; thence North 02°47’02 East, 24.898 feet to a point on a 342.91 foot radius curve to the left; thence along said curve 126.04 feet through a central angle of 21°03’34’ (chord bears North 1l°03’57” East, 125.331 feet); thence South 89°27’51” East, 0.090 feet; thence South, 52.306 feet to a point of curvature with a 300 foot radius curve to the left; thence along said curve 133.52 feet through a central angle of 25°30’00” (chord bears South 12°45’00” East, 132.419 feet); thence South 25°30’00” East, 18.726 feet to the point of beginning. Contains 2,621 Sq. Ft. 0.060 Acres.
SECTION 2. CONDITIONS. This Ordinance shall not become effective until a subdivision amendment has been approved by the City incorporating the surplus property into the petitioners property at 1321 South Swaner Road, which includes provisions for the existing fire hydrant to be maintained and, further, an easement prohibiting construction of permanent structures over and adjacent to existing water mains and sewer mains.
SECTION 3. RESERVATION AND DISCLAIMERS. The above closure is expressly made SUBJECT TO all existing rights-of-way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the CityT s water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights-of-way or easements of private third parties.
SECTION 4. The City Recorder is instructed to not publish this Ordinance until the Mayor has certified that the condition specified in Section 2 has been met. If the condition is not met within one year, the Mayor may extend the time for the performance of the condition by an additional year. If the condition has not been met within the year or any extension made, this Ordinance shall be null and void, and shall not be published or recorded.
SECTION 5. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be thereafter recorded with the Salt Lake County Recorder.
