SALT LAKE CITY ORDINANCE
No. 62 of 1995
(Closing a portion of Front Street south of 1400 South and closing a portion of an alley extending south of Albermarle Avenue at 200 West and approximately 1400 South pursuant to Petition No. 400-95-33)
AN ORDINANCE CLOSING A PORTION OF FRONT STREET SOUTH OF 1400 SOUTH AND CLOSING A PORTION OF AN ALLEY EXTENDING SOUTH OF ALBERMARLE AVENUE AT 200 WEST AND APPROXIMATELY 1400 SOUTH PURSUANT TO PETITION NO. 400-95-33.
WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City’s interest in the public street and alley described below is not necessary for use by the public as a street or alley and that closure of said street and alley will not be adverse to the general public’s interest nor divest the City of title to the property to the closed portions without subsequent documents of transfer after sale for fair market value.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That a portion of Front Street south of 1400 South and a portion of an alley extending south of Albermarle Avenue at 200 West and approximately 1400 South, which are the subject of Petition No. 400-95-33 and which are more particularly described below, be, and the same hereby are, CLOSED and declared no longer to be needed or available for use as a public street or alley, with the title to the closed portions remaining with the City until subsequent sale for market value:
Said street and alley are more particularly described as follows:
Street Closure - Front Street
South of 1400 South and west of Jefferson Street Commencing at a point 38 feet north from the southeast corner of Lot 15, Block 5, West Temple Addition; located in the northeast quarter of Section 13, T.1S., R.1W., S.L.B. & M.; thence north 37 feet to the northeast corner of Lot 13; thence east 66 feet to a point on the west line of Lot 8, Block 4 of said subdivision; thence south 37 feet; thence west 66 feet to the point of beginning.
Alley Closure - South of Albermarle Avenue, a continuation to the south of 200 West Street and approximately 1400 South.
Commencing at the northwest corner of Lot 13, Block 5, West Temple Addition; located in the northeast quarter of Section 13, T.lS., R.1W.,
S.L.B. & M.; thence south 115 feet to 15 feet south of the southwest corner of Lot 16; thence west 13 feet to the west boundary line of said alley; thence north 115 feet along said boundary line; thence east 13 feet to the point of beginning.
SECTION 2. CONDITIONS. This Ordinance shall not become effective until the following conditions have been met:
A. The Petitioner has submitted plans showing the removal of all existing conflicting utilities and fire hydrants from the sites and the appropriate reconstruction of those utilities and fire hydrants in a manner acceptable to Public Utilities and the Fire Department at Petitioner’s cost and shall prepare a dedication of the necessary easements for the relocated utilities and fire hydrants in a form acceptable to the City’s Real Property Division.
B. The Petitioner has received approval from the City for an amended subdivision plat showing the closures and appropriately altering the lot lines.
SECTION 3. RESERVATION AND DISCLAIMERS. The above closures are expressly made SUBJECT TO all existing rights- of-way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City’s water and sewer facilities, and all of them. Said closures are also SUBJECT TO any existing rights-of-way or easements of private third parties.
SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be thereafter recorded with the Salt Lake County Recorder. The City Recorder is instructed to not publish or record this Ordinance until the Mayor has certified that the conditions specified in Section 2 have been met. If the conditions have not been met within one year, the Mayor may extend the period for an additional year. If the conditions have not been met within the first year or any extension, this Ordinance shall be null, void, of no effect, and shall not be published or recorded.
