SALT LAKE CITY ORDINANCE

No. 56 of 1995

 

(Sun Tree Properties, Inc. Annexation and Zoning Approval pursuant to Petition No. 400-95-002)

AN ORDINANCE RECOGNIZING THE ADOPTION OF AMENDMENT 6A TO THE MASTER ANNEXATION POLICY DECLARATIONS; EXTENDING THE LIMITS OF SALT LAKE CITY TO INCLUDE THE SUN TREE PROPERTIES, INC., ANNEXATION, ZONING THE SAME RESIDENTIAL R-1-7000 BY AMENDING THE ZONING AND AMENDING THE SALT LAKE CITY COUNCIL DISTRICT BOUNDARY MAP.

WHEREAS, Petition No. 400-95-002 was filed with the City Recorder of Salt Lake City, together with a plat showing the tract of land to be annexed hereafter to be known as the Sun Tree Properties, Inc. Annexation, requesting that the contiguous, irregularly shaped parcel of approximately 3.28 acres of unincorporated territory lying 2900 South 2000 East of Salt Lake County be taken within the City limits of Salt Lake City Corporation to extend the City’s limits; and

WHEREAS, the petition was signed by a majority of the owners of real property and the owners of more than one-third in value of all real property, as shown by the last assessment roles, situated in the tract hereinafter described; and

WHEREAS, in order to facilitate the orderly expansion of the City’s boundaries, the City has previously adopted a Master Annexation Policy Declaration on June 20, 1979. The proposed annexation lies within Study Area No. 6 of said Declaration and is the specific subject of Amendment 6A of said Declaration which was approved after favorable Planning Commission review; and

WHEREAS, the City Council of Salt Lake City, after examining the petition and having the petition favorably reviewed by the various departments of the City and the Planning Commission, and having accepted the petition by Resolution No. 47 of 1995, and having considered the petition at a publicly advertised hearing held June 1, 1995, and after finding the proposed annexation to be consistent and in keeping with the City’s Master Annexation Policy Declaration for Study Area No. 6 and Amendment 6A, the Council voted by two-thirds or greater vote of its membership, in favor of the annexation; and

WHEREAS, no objection or contest to such annexation or amendment has been filed as required by law or is presently pending; and

NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. Area. That the City limits of Salt Lake City be, and the same hereby are, enlarged and extended so as to include the following rectangularly shaped approximately 3.28 acre parcel of land located at approximately 2900 South 2000 East in Salt Lake County, Utah:

BEGINNING AT A POINT SOUTH 0°04’05” EAST ALONG THE 2000 EAST STREET MONUMENT LINE 532.49 FEET AND SOUTH 89°53’24” WEST 24.00 FEET FROM A BRASS CAP MONUMENT AT THE INTERSECTION OF ATKIN AVENUE AND 2000 EAST STREET, SAID BRASS CAP MONUMENT BEING SOUTH 00°13’54” EAST 626.96 FEET (SOUTH 00°16’54” EAST 609.255 FEET CALCULATED FROM S.L.C. CO. ARP) AND WEST 24.00 FEET FROM THE NORTHEAST CORNER OF SECTION 28, TOWNSHIP 1 SOUTH, RANGE 1 EAST, SALT LAKE BASE & MERIDIAN, AND RUNNING THENCE SOUTH 0°04’05” EAST 9.00 FEET EAST OF THE WEST LINE OF 2000 EAST STREET 279.02 FEET; THENCE NORTH 89°57’21” WEST 124.63 FEET; THENCE NORTH 00°0l’26” WEST 11.50 FEET; THENCE NORTH 89°57’21” WEST 405.45 FEET; THENCE NORTH 00°14’21” WEST 266.09 FEET; THENCE NORTH 89°53’24” EAST 530.85 FEET TO POINT OF BEGINNING. CONTAINS 3.282 ACRES.

SECTION 2. Zoning. Be it further ordained and declared

that the above Sun Trees Properties, Inc. Annexation is hereby zoned Residential R-1-7000 and the Use District Map as adopted by Section 21.14.020 of the Salt Lake City Code relating to the boundaries of use districts shall be, and the same hereby is amended by the addition of the Sun Tree Properties, Inc. Annexation zoned Residential R-1-7000.

SECTION 3. City Council Maps. The Salt Lake City Council District Map is hereby amended to include the Sun Tree Properties, Inc. Annexation in Council District 7 as specified on such map.

SECTION 4. General Jurisdiction. Be it further ordained and declared that the tract of land described above in Section 1 shall henceforth be within the corporate limits of Salt Lake City Corporation. All ordinances, jurisdictions, rules and obligations of, or pertaining to, Salt Lake City are extended over and made applicable and pertinent to this tract of land; and the streets, blocks, alleys and public ways of said tract shall be controlled and governed by the ordinances, rules and regulations of Salt Lake City in that behalf. The monuments of the City Engineer shall henceforth be taken therein as the standards of location and distances of said land.

SECTION 5. Conditions Precedent. Prior to the acceptance of this annexation and the publication of this Ordinance, the petitioners shall enter into an Annexation Agreement with the City requiring such terms and conditions as have been recommended by the Planning Commission in a form approved by the City Attorney, which Annexation Agreement is attached hereto and incorporated herein by reference.

SECTION 6. Filings and Notice. Upon the passage and publication of this Ordinance, the Recorder of Salt Lake City is hereby directed to file with the County Recorder of Salt Lake County a copy of the approved Sun Tree Properties, Inc. Annexation plan or map, duly certified and acknowledged, together with a certified copy of this Ordinance. The City Recorder is further directed to provide notice to the Utah State Tax Commission pursuant to applicable state law.

SECTION 7. Publication and Effect. This Ordinance shall take effect upon the date of its first publication. The City Recorder is instructed not to publish this Ordinance until an annexation plat prepared by a registered professional engineer or surveyor at the developer’s expense has been submitted to the City meeting all City standards for such a document and has been signed by the Mayor and the Mayor certifies that no written protest was received from an affected entity within five (5) days of the Council’s hearing.
