SALT LAKE CITY ORDINANCE
No. 4 of 1994
(Correcting the legal description of Ordinance 90 of 1992 closing a portion of 1300 South right-of-way along the North side of 1300 South between Glendale Street and the Jordan River pursuant to Petition No. 400-92-98)
AN ORDINANCE CORRECTING THE LEGAL DESCRIPTION OF ORDINANCE 90 OF 1992 CLOSING A PORTION OF 1300 SOUTH RIGHT-OF-WAY ALONG THE NORTH SIDE OF 1300 SOUTH BETWEEN GLENDALE STREET AND THE JORDAN RIVER, PURSUANT TO PETITION NO. 400-92-98.
WHEREAS, the City Council of Salt Lake City has determined that the property description of Ordinance No. 90 of 1992 is in error and should be corrected;
WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City’s interest in the public right-of-way described below is not necessary for use by the public as a right-of-way and that closure of said right-of-way will not be adverse to the general public’s interest nor divest the City of title to the property without subsequent documents of transfer.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Ordinance No. 90 of 1992 is hereby repealed.
SECTION 2. That a portion of 1300 South right-of-way along the North side of 1300 South between Glendale Street and the Jordan River, which is the subject of Petition No. 400-92-98 and which is more particularly described below, be, and the same hereby is, CLOSED and declared no longer to be needed or available for use as a public right-of-way, with the title remaining with the City until subsequent sale for market value or other consideration acceptable to the City:

A parcel of land located in the Southwest Quarter of Section 11, Township 1 South, Range 1 West Salt Lake Base and Meridian being further described as follows:
Beginning at a point due East 1655.101 feet and North 00°06’52” West 380.703 feet and South 89°55’56” East 50.000 feet from the Southeast Corner of Section 11, Township 1 South, Range 1 West, Salt Lake Base and Meridian; thence from said point of beginning North 89°55’56” East 263.013 feet along the northerly right-of- way of 1300 South Street; thence South ll°49’00” East 20.428 feet; thence south 89°55’56” West 249.171 feet to a point on a 18.000 foot radius curve to the right (bearing to the radius point bears North 00°04’04” West); thence along arc of said curve 28.260 feet through a central angle of 89°57’12”; thence North 00°06’52” West 2.015 feet to the point of beginning. Contains an area of 5232 square feet more or less.
SECTION 3. RESERVATION AND DISCLAIMERS. The above closure is expressly made SUBJECT TO all existing rights-of-way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City’s water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights-of-way or easements of private third parties.
SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be thereafter recorded with the Salt Lake County Recorder.
