(Vacating portions of Block 13 and 21 end all of Blocks 19 and 20 of Jordan Place Subdivision, portions of Blocks 4 and 5 of City Park Subdivision, a portion of Block 2 and all of Block 3 of Butte Subdivision and closing a portion of Glenn Street Pursuant to Petition No. 400-93-86) AN ORDINANCE APPROVING THE VACATION OF PORTIONS OF BLOCK 13 AND 21 AND ALL OF BLOCKS 19 AND 20 OF JORDAN PLACE SUBDIVISION, PORTIONS OF BLOCKS 4 AND 5 OF CITY PARK SUBDIVISION, A PORTION OF BLOCK 2 AND ALL OF BLOCK 3 OF BUTTE SUBDIVISION AND CLOSING A PORTION OF GLENN STREET, AS REQUIRED BY SECTION 10-9-808, UTAH CODE ANNOTATED, PURSUANT TO PETITION NO. 400-93-86. WHEREAS, Petition No. 400-93-86 was filed with the City by Zion’s First National Bank, Salt Lake Community College and the State of Utah Parks Division requesting the City to allow the vacation of portions of Block 13 and 21 and all of Blocks 19 and 20 of Jordan Place Subdivision, portions of Blocks 4 and 5 of City Park Subdivision, a portion of Block 2 and all of Block 3 of Butte Subdivision and to partially close Glenn Street; and WHEREAS, one hundred percent of the owners of the property within and adjacent streets to the subdivisions have not consented to the vacation; and

WHEREAS, the City Council has held a public hearing after giving the required notices and has reviewed the proposed plat vacations which have been previously preliminarily approved by the Planning Commission on September 16, 1993; and

WHEREAS, good cause exists for the vacation of the plats and the City Council finds neither the public nor any person will be materially injured by the proposed vacations;

WHEREAS, the City Council finds after public hearing that the City’s interest in Glenn Street, described below, is not necessary for use by the public as a street and that closure of Glenn Street will not be adverse to the general public’s interest nor divest the City of title to the property without subsequent documents of transfer; and

NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. The City hereby approves the proposed vacations of portions of Block 13 and 21 and all of Blocks 19 and 20 of Jordan Place Subdivision, portions of Blocks 4 and 5 of City Park Subdivision and a portion of Block 2 and all of Block 3 of Butte Subdivision as conditionally approved by the Planning Commission on September 16, 1993. The description of the vacated plats is attached and incorporated as Exhibit A to this Ordinance.

SECTION 2. That a portion of Glenn Street, which is the subject of Petition No. 400-93-86 and which is more particularly described below, be, and the same hereby is, CLOSED and declared no longer to be needed or available for use as a public street, with the title remaining with the City until subsequent sale for market value:

Said street is more particularly described as follows:

Closing a portion of Glenn Street Commencing at a point on the North East corner of Lot 21, Block 4, City Park Subdivision; thence 346 feet South; thence 66 feet East; thence 155 feet North; thence 30 feet West; thence 191 feet North; thence 36 feet West to the point of beginning.

SECTION 3. RESERVATION AND DISCLAIMERS. The above closure is expressly made SUBJECT TO all existing rights-of--way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City’s water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights-of-way or easements of private third parties.

SECTION 4. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder.
