(Rezoning property located at approximately 1950 West and 1500 feet north of North Temple Pursuant to Petition No. 400-706)
AN ORDINANCE AMENDING SECTION 21.14.020 OF THE SALT LAKE CITY CODE RELATING TO ZONING AND FIXING OF BOUNDARIES OF USE DISTRICTS PURSUANT TO PETITION NO. 400-706.
WHEREAS, in response to rezoning petition No. 400-706, the City Council of Salt Lake City, Utah has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing and demographic details of the area and the Master Plan as part of its deliberation. Pursuant to these deliberations, the Council has concluded that the proposed change of zoning for the property located at approximately 1950 West and 1500 feet north of North Temple is appropriate for the development of the community in that area; and
THEREFORE, the City Council of Salt Lake City, Utah hereby adopts the following amendments to the Use District provisions of Title 21.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That the Use District Map, as adopted by Section 21.14.020 of the Salt Lake City Code, relating to the fixing of boundaries of Use Districts, be, and the same hereby is, AMENDED to read as follows:
Sec. 21.14.020. Boundaries of Districts--Use District Map Adopted.
That the following-described parcel of real property in Salt Lake City, Utah presently zoned Residential “R-l” is hereby rezoned Commercial “C-i” and the Use District Map is amended accordingly:

Beginning at a point S 89°5l’50” E 16.50 feet from the West Quarter Corner of Section 34, T1N, R1W, SLB & M and running thence S 89°5l’50” E 0.67 feet; thence N 0°l3’l6” E along the east line of Interstate Freeway 215 Right of Way as determined by right of way markers a distance of 538.00 feet; thence S 89°51’50” E 218.26 feet; thence S 0°04’28” W 335.00 feet; thence S 89°5l’50” E 458.80 feet; thence N 0°04’28” E 85.00 feet; thence S 89°5l’50” E 120.20 feet to the west line of Morton Meadows Plat C; thence S 0°04’28” W along said line 552.00 feet to the southwest corner of Lot 97 of said plat; thence N 89°51’50” W 799.89 feet to the east right of way line of Interstate Freeway aforesaid; thence N 0°l2’07” E 264.00 feet to the point of beginning. Contains 10.483 acres.
SECTION 2. CONDITIONS. This ordinance shall not become effective until the Mayor has certified that a building permit is ready for issuance based upon:
a. An approved site plan which shall include the provision of a 30-foot landscaped buffer consistent with the State Tax Commission development along the residential properties to the east and north; and
b. No access shall be allowed to 400 North except for emergency access required by the Fire Department which access point shall be protected with crash gates in a form acceptable to the City.
SECTION 3. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder. The City Recorder is instructed to not record or publish this ordinance until the Mayor has certified that the conditions specified in Section 2 above have been met. In the event that the conditions have not been met within one year from the date of this ordinance the Mayor may extend the time for performance by an additional year. If the conditions have not been met within the time permitted by this ordinance the City Recorder is instructed to not record or publish the ordinance, which shall become null, void and of no effect.
