(Partial Vacation of the Chas S. Desky 4th Addition Subdivision Pursuant to Petition No. 400-93-122)
AN ORDINANCE APPROVING THE PARTIAL VACATION OF THE CHAS S. DESKY 4TH ADDITION SUBDIVISION, AS REQUIRED BY SECTION 10-9-808, UTAH CODE ANNOTATED, PURSUANT TO PETITION NO. 400-93-122.
WHEREAS, Petition No. 400-93-122 was filed with the City by Sutherland Lumber Co. and Johansen Thackeray, requesting the City to allow the partial vacation of the Chas S. Desky 4th Addition Subdivision; and
WHEREAS, one hundred percent of the owners of the property within and adjacent to the subdivision have not consented to the amendment; and
WHEREAS, the City Council has held a public hearing after giving the required notices and has reviewed the preliminary plat of the partial vacation which has been previously preliminarily approved by the Planning Commission on February 3, 1994; and
WHEREAS, good cause exists for the partial vacation of the plat and the City Council finds neither the public nor any person will be materially injured by the proposed partial vacation;
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. The City hereby approves the proposed partial vacation of the Chas S. Desky 4th Addition Subdivision as conditionally approved by the Planning Commission on February 3, 1994. A copy of the partially vacated plat shall be retained by the City Recorder as Exhibit A to this Ordinance. The Planning Director is authorized to grant final plat approval subject to compliance with applicable City ordinances and the conditions imposed by the Planning Commission.
SECTION 2. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder. The City Recorder is instructed to not record or publish this ordinance until the Planning Division certifies that the partially vacated plat is approved and recordable.
