(Closing all of Duder Street and a portion of Gertie Avenue pursuant to Petition No. 400-93-122)

AN ORDINANCE CLOSING ALL OF DUDER STREET AND A PORTION OF GERTIE AVENUE, PURSUANT TO PETITION NO. 400-93-122.

WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City’s interest in the public streets described below are not necessary for use by the public as streets and that closure of said streets will not be adverse to the general public’s interest nor divest the City of title to the properties without subsequent documents of transfer.

NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. That all of Duder Street and a portion of Gertie Avenue, which are the subject of Petition No. 400-93-122 and which are more particularly described below, be, and the same hereby are, CLOSED and declared no longer to be needed or available for use as public streets, with the title remaining with the City until subsequent sale for market value or other appropriate consideration as approved by the Mayor:

Said streets are more particularly described as follows:

Duder Street: Beginning at. the Southwest corner of Lot 32, Block 1, Deskys Fourth Addition, said point being South 89 58’38” West 718.5 ft. and north 0 04’20” East 65.4 ft. from a Salt Lake City Survey Monument in the intersection of North Temple Street and Redwood Road, and running: thence North 0 04’20” East 592.04 ft. along the east line of said Duder Street to the Northwest corner of Lot 6, Block 3, Deskys 4th Addition; thence South 89 58’38 West 30.47 ft. to the west line of Duder Street; thence South 0 08’36 East 592.04 ft. along the west line of Duder Street to the north 1ine of North Temple Street; thence North 89 58’38” East 28.22 ft. along the north line of North Temple Street to the point of beginning. 0.40 acres

Gertie Avenue: Beginning at the intersection of the east line of Duder Street and the south line of Gertie Street, said point being North 0 04’20” East 88.0 ft. from the Southwest corner of Lot 11, Block 3, Deskys 4th Addition, said point also being South 89 58’38” West 718.5 ft. and North 0 041201! East 482.4 ft. from a Salt Lake City Survey monument in the intersection of North Temple Street and Redwood Road, and running thence North 0 04’20” East 50.04 feet to the north line of Gertie Street; thence North 89 58’38” East 151.63 ft. along the north line of Gertie Street; thence South 0 04’20” West 50.04 ft. to the south line of Gertie Street; thence South 89 58’38” West 151.63 ft. along the south line of Gertie Street to the point of beginning. 0.17 acres

SECTION 2. RESERVATION AND DISCLAIMERS. The above closures are expressly made SUBJECT TO all existing rights-of-way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City’s water and sewer facilities, and all of them. Said closures are also SUBJECT TO any existing rights-of-way or easements of private third parties.

SECTION 3. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be thereafter recorded with the Salt Lake County Recorder.
