(Rezoning property located at approximately 1800 West North Temple pursuant to Petition No. 400-93-122)

AN ORDINANCE AMENDING SECTION 21.14.020 OF THE SALT LAKE CITY CODE RELATING TO ZONING AND FIXING OF BOUNDARIES OF USE DISTRICTS PURSUANT TO PETITION NO. 400-93-122.

WHEREAS, in response to the rezoning petition No. 400-93- 122, the City Council of Salt Lake City, Utah has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing and demographic details of the area and the Master Plan as part of its deliberation. Pursuant to these deliberations, the Council has concluded that the proposed change of zoning for the property located at approximately 1800 West North Temple is appropriate for the development of the community in that area; and

THEREFORE, the City Council of Salt Lake City, Utah hereby adopts the following amendments to the Use District provisions of Title 21.

Be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. That the Use District Map, as adopted by Section 21.14.020 of the Salt Lake City Code, relating to the fixing of boundaries of Use Districts, be, and the same hereby is, AMENDED to read as follows:

Sec. 21.14.020. Boundaries of Districts--Use District Map Adopted.

That the following-described parcel of real property in Salt Lake City, Utah presently zoned Residential “R-6” and Commercial “C-1” is hereby rezoned Community Shopping Center “CS” and the Use District Map is amended accordingly:

Beginning at a point 395 ft. more or less from the Southeast corner of Block 1, Deskys 4th Addition Subdivision; thence West 635 ft. more or less along the north line of North Temple Street to the Southeast corner of Block 1, Deskys 5th Addition Subdivision; thence North 770 ft. more or less to a point on the south property line of Lot G7, Morton Meadows Subdivision Plat A; thence East 510 ft. more or less; thence South 350 ft. more or less; thence East 125 ft. more or less; thence South 420 ft. more or less to the point of beginning.

SECTION 2. CONDITIONS. This ordinance shall not become effective until the Mayor has certified that a building permit for the property is in a form ready to be issued by the City and a new Subdivision Plat for the property is ready for recordation.

SECTION 3. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder. The City Recorder is instructed to not record or publish this ordinance until the Mayor has certified that the conditions specified in Section 2 above have been met. In the event that the conditions have not been met within one year from the date of this ordinance, the Mayor may extend the time for performance by an additional year. If the conditions have not been met within the time period permitted by this ordinance, the City Recorder is instructed to not record or publish the ordinance, which shall become null, void and of no effect.
