(Rezoning property located at the eastern terminus of Tomahawk Drive Pursuant to Petition No. 400-94-10)

AN ORDINANCE AMENDING SECTION 21.14.020 OF THE SALT LAKE CITY CODE RELATING TO ZONING AND FIXING OF BOUNDARIES OF USE DISTRICTS PURSUANT TO PETITION NO. 400-94-10.

WHEREAS, in response to rezoning petition No. 400-94-10, the City Council of Salt Lake City, Utah has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing and demographic details of the area and the Master Plan as part of its deliberation. Pursuant to these deliberations, the Council has concluded that the proposed change of zoning for the property located at the eastern terminus of Tomahawk Drive is appropriate for the development of the community in that area; and

THEREFORE, the City Council of Salt Lake City, Utah hereby adopts the following amendments to the Use District provisions of Title 21.

Be it ordained by the City Council of Salt Lake City, Utah:

SECTION 1. That the Use District Map, as adopted by Section 21.14.020 of the Salt Lake City Code, relating to the fixing of boundaries of Use Districts, be, and the same hereby is, AMENDED to read as follows:

That the following-described parcel of real property in Salt Lake City, Utah presently zoned Preservation “P-1” is hereby rezoned Residential “R-l” with Foothill Development Overlay “F-1”, and the Use District Map is amended accordingly:

Beginning at a point which is South 63°38’53” East 31.62 feet from the Southeast Corner of Lot 8, Arlington Hills Subdivision, Plat H, as recorded in the Salt Lake County Recorder’s office, said point also being South 1618.46 feet and East 416.25 feet from the North Quarter Corner of Section 33, Township 1 North, Range 1 East, Salt Lake Base and Meridian; and running thence Northwesterly along the arc of a 735.00 foot radius curve to the right, the center of which bears North 64°37’57” East, through a central angle of 8°40’05” 111.19 feet to a point on a 50.00 foot radius curve to the right; the center of which bears North 21°28’51” East; thence along the arc of said curve and through a central angle of 49°50’52” 43.50 feet to a point on a 755.00 foot radius curve to the right, the center of which bears North 76°09’16” East; thence Northerly along the arc of said curve and through a central angle of 05°06’35” 67.33 feet; thence East 60.55 feet to a point of a 50.00 foot radius curve to the right; thence Southeasterly along the arc of said curve and through a central angle of 55°01’48” 48.02 feet; thence North 00°01’57” West 20.70 feet; thence North 89°58’03” East 384.66 feet; thence South 00°01’57” East 200.00 feet; thence North 89°58’15” West 404.17 feet to the point of beginning.

Contains 89,520 square feet, or 2.055 acres.

SECTION 2. CONDITION. This ordinance shall not become effective until the Mayor has certified that a subdivision plat showing the one lot to be rezoned with a defined buildable area only on slopes less than thirty percent (30%) is ready for final approval by the Planning Director.

SECTION 3. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder. The City Recorder s instructed to not record or publish this ordinance until the Mayor has certified that the condition specified in Section 2 above has been met. In the event that the condition has not been met within one year from the date of this ordinance the Mayor may extend the time for performance by an additional year. If the condition has not been met within the time permitted by this ordinance the City Recorder is instructed to not record or publish the ordinance, which shall become null, void and of no effect.
