September 9, 1997

 

The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, September 9, 1997, at 6:00 p.m. in Room 315, City Council Office, City County Building, 451 South State.

 

      The following Council Members were present:

 

            Lee Martinez            Joanne Milner           Mary Mark

            Deeda Seed              Bryce Jolley

 

      The following Council Members were absent:

 

            Tom Godfrey             Keith Christensen

 

      Roger Black, Director of Management Services; Roger Cutler, City Attorney; Cindy Gust-Jenson, Executive Council Director; and Beverly Jones, Deputy City Recorder were present.

 

      Councilmember Seed presided at and conducted the meeting.

 

      #1.  The Council led the Pledge of Allegiance.

 

      #2. Councilmember Jolley moved and Councilmember Mark seconded to approve the minutes of the Salt Lake City Council meeting held September 2, 1997, which motion carried, all members present voted aye.

CITIZEN COMMENTS TO THE CITY COUNCIL

 

      Linda Lepreau, 252 Douglas Street, said she was concerned about alley closures.  She said it was time for the Council to take a look at the policy which allowed alley closures in general.  She said when people were allowed to close alleys, the opportunity to have off street parking behind houses and garages was taken away.  She said there was more congestion on the streets.  She said it was a mistake to allow commercial properties to close alleys to expand.  She said these blocks were super blocks which promoted automobile traffic and discouraged pedestrian traffic.

 

CONSENT AGENDA

 

      ACTION: Councilmember Jolley moved and Councilmember Mark seconded to approve the Consent Agenda, which motion carried, all members present voted aye.

 

      #1. RE: Setting the date of October 7, 1997 at 6:00 p.m. to accept public comment and consider adopting ordinances closing a portion of Richards Street located between 1300 South and Paxton Avenue; closing an alley located between 1300 South and Paxton Avenue and between Richards Street and West Temple; and vacating a portion of the Columbia Subdivision pursuant to Petition No. 400-94-29.

      #2. RE: Adopting Resolution 49 of 1997 authorizing the approval of an interlocal cooperation agreement between Salt Lake City Corporation, Salt Lake County and the State of Utah Division of Wildlife Resources amending the interlocal agreement by extending the expiration date of the agreement to December 31, 1997.

PUBLIC HEARINGS

 

      #1. RE: Accept public comment and consider adopting an ordinance closing a portion of an alley located between Andrew Avenue and Van Buren Avenue and between 400 West and 300 West pursuant to Petition No. 400-97-02.

 

      ACTION: Councilmember Milner moved and Councilmember Martinez seconded to close the public hearing, which motion carried, all members present voted aye.

 

      Councilmember Christensen moved and Councilmember Milner seconded to adopt Ordinance 56 of 1997, which motion carried, all members present voted aye.

 

      DISCUSSION: Steve Bunting said he represented the Bunting Family Limited Partnership.  He said the property being petitioned was an alley which had been used as a service and access alleyway.  He said they had been encroaching upon the alley for 40 years and had used the alley as part of their manufacturing facility.  He said they had an opportunity to sell one of the buildings on this property.  He said it was important to clarify the legal status and title of the alley.

      #2. RE: Accept public comment and consider adopting an ordinance closing a portion and vacating a portion of an alley located between 200 East and 300 East and between Kelsey and Hampton Avenues pursuant to Petition No. 400-96-111.

 

      ACTION: Councilmember Martinez moved and Councilmember Milner seconded to close the public hearing, which motion carried, all members present voted aye.

 

      Councilmember Mark moved and Councilmember Milner seconded to adopt Ordinance 55 of 1997, which motion carried, all members present voted aye.

 

      DISCUSSION:  Aaron Stubbs, 269 East Kelsey Avenue, spoke in favor of the closure.

      #3. RE:  Accept public comment and consider adopting an ordinance amending the Fiscal Year 1997-98 budget.

 

      ACTION:  Councilmember Jolley moved and Councilmember Martinez seconded to close the public hearing, which motion carried, all members present voted aye.

 

      Councilmember Jolley moved and Councilmember Milner seconded to adopt Ordinance 57 of 1997 with the following exceptions; 1) transfer $48,864 from the Police Department to General Fund contingency, 2) add .60 for a full time employee to the Council Office staffing document, and 3) appropriate $20,000 from the narcotic asset forfeiture fund to Capital Planning to be administered in keeping with other City grant programs in coordination with the Police Department, which motion carried, all members present voted aye.
