The City Council of Salt Lake City, Utah met in Regular Session on Thursday, September 5, 1996, at 5:30 p.m. in Room 325, City County Building, 451 South State Street.

 

      The following Council Members were present:

 

            Stuart Reid                   Joanne Milner                 Sam Souvall

            Deeda Seed                    Tom Godfrey                   Bryce Jolley

            Keith Christensen

 

      Mayor Deedee Corradini; Lynn Pace, Assistant City Attorney; Cindy Gust-Jenson, Executive Council Director; and Scott Crandall, Deputy Recorder were present.

 

      Councilmember Christensen presided at and conducted the meeting.

 

 

UNFINISHED BUSINESS

 

      #1. RE:     Consider an appeal by Ms. Jan Haug of Planning Commission decision for Conditional Use, Petition No. 410-186, submitted by Eastland Regency Company for a commercial development located at 2800 East Parley's Way, known as the Woodbury Project.

 

      ACTION: Councilmember Reid moved and Councilmember Godfrey seconded that the City Council uphold the Planning Commission decision based upon review of the appeal, the information provided on the record and Section 27-8 Standards for Conditional Use in the Zoning Ordinance based upon the following findings: 1) no evidence was improperly excluded from consideration; and 2) the decision made by the Planning Commission was supported by the findings of fact based upon the applicable standards of approval, which motion carried, all members voted aye, except Councilmember Milner, who voted nay.

     

      DISCUSSION: Councilmember Christensen said the record needed to reflect the Council was appropriately convened as both Committee of the Whole and City Council.

 

      Councilmember Jolley said he wanted the City to address traffic flow problems within the project area including Wilshire and Stringham.  He asked if it was appropriate to attach a legislative intent to the motion.

 

      Lynn Pace, Assistant City Attorney, said the Council could not approve the appeal and attach conditions.  He said a separate motion could be made.

 

      Cindy Gust-Jenson, Executive Council Director, said Wilshire and Stringham could be handled as separate directives to the Administration.

 

      Councilmember Christensen said this was a sensitive issue.  He said the Council had limited authority in the appeal review process.  He said he did not believe there was sufficient evidence to appropriately overturn the Planning Commission's decision.

 

      Councilmember Milner said she felt the information presented was inconclusive and wanted more data.

 

      Councilmember Seed said this appeal raised questions about the process before it came before the Council. She said she was also concerned about the quality of traffic studies.
