September 17, 1996

 

The City Council of Salt Lake City, Utah, met in Regular Session on Tuesday, September 17, 1996, at 6:00 p.m. in Room 315, City Council Office, City County Building, 451 South State.

 

      The following Council Members were present:

 

            Stuart Reid                 Joanne Milner                 Sam Souvall

            Deeda Seed                   Tom Godfrey                  Bryce Jolley

            Keith Christensen

 

      Mayor Deedee Corradini; Roger Cutler, City Attorney; Cindy Gust-Jenson, Executive Council Director; and Bonnie Ferrin, Deputy City Recorder were present.

 

      Councilmember Christensen presided at and Councilmember Reid conducted the meeting.

 

      #1.  The Council led the Pledge of Allegiance.

 

      #2.  Councilmember Godfrey moved and Councilmember Souvall seconded to approve the minutes of the Salt Lake City Council meeting held September 3 and September 10, 1996, and Joint Redevelopment Agency/City Council minutes from July 1, 1996, which motion carried, all members voted aye.

CITIZEN COMMENTS

 

      Bob Fisher, Hannibal Street, said vacant buildings between 100 South and 300 South should be boarded up.  He also suggested that the procedure should be changed so citizens did not need to state their address when speaking to the Council.  He said he was concerned their homes could be burglarized while attending the meeting.

 

      Bruce Markosian, 304 First Avenue, said he was concerned about the ordinance regarding 3 and 4-plexes.  He said he found out about the ordinance only one week ago.  He said property owners should be notified before an ordinance which directly involved them went into effect.

 

      He said he was an architect and had lived in his home for 20 years. He said he renovated the home from a rundown 6-plex to a nicely done 4-plex.  He said over the 20 years of renovation, he had taken out several permits and complied with the current code regulations at the time.  He said each time he took out a new permit, inspectors would tell him the older work did not meet code and needed to be fixed.  He said it may not have met the newest codes, but did meet the code at the time it was completed.  He said it was a hassle to reeducate new inspectors as to what had happened in the past, when he would start a new phase of renovation to his home.

 

      He said for people who lived on their own properties, the issue went beyond safety.  He said his home was safe.  He said no more than seven individuals lived in the home full time.  He said many single family homes had seven or more residents living in the home.  He said if the ordinance was passed because of safety issues, then why was it not a legitimate concern for every single family home owner as well.

 

      He said he spoke with Jennifer Seelig, Public, Policy & Research Analyst for the Council, and was told that if the ordinance passed to completion, this would change the amount of properties inspected from approximately 800 to approximately 4,000 per year.  He said the City would need to bring on additional inspectors to handle the growth.  He said as a taxpayer, he resented having to pay additional taxes to support what he considered unfair and intrusive.  He said he hoped that the issue of the owner-occupied properties was still being evaluated by the Council.  He said he would appreciate the Council taking his comments into consideration.

      #1.  RE:  Adopting a legislative action item asking for Administrative review of enhancing the citizen component of the Police Department's Internal Affairs/Use of Force Oversight Function.

 

      ACTION:  Councilmember Seed moved and Councilmember Godfrey seconded to refer item to Committee of the Whole, which motion carried, all members voted aye.

      #2.  RE:  Adopting an ordinance designating a body other than the City Council as the Appeal Body for the Planning Commission conditional uses and Historic Landmark's appeals.

 

      ACTION:  Councilmember Souvall moved and Councilmember Milner seconded to refer to Committee of the Whole for discussion, which motion carried, all members voted aye.

      #1.  RE:  Accept public comment and consider adopting an ordinance to amend the Fiscal Year 1996-97 Budget.

 

      ACTION:  Councilmember Godfrey moved and Councilmember Seed seconded to close the public hearing, which motion carried, all members voted aye.

 

      Councilmember Godfrey moved and Councilmember Seed seconded to adopt Ordinance 69 of 1996, which motion carried, all members voted aye.

      #2.  RE: Accept public comment and consider adopting an ordinance amending Chapter 21A.34.020 E of the Salt Lake City Zoning Ordinance.

 

      ACTION:  Councilmember Godfrey moved and Councilmember Seed seconded to close the public hearing, which motion carried, all members voted aye.

 

      Councilmember Godfrey moved and Councilmember Seed seconded to adopt Ordinance 70 of 1996, which motion carried, all members voted aye.

      #3.  RE: Accept public comment and consider adopting a resolution to amend the fiscal year 1996-97 budget for the Municipal Building Authority of Salt Lake City.

 

      ACTION:  Councilmember Godfrey moved and Councilmember Seed seconded to recess as City Council and convene as the Municipal Building Authority, which motion carried, all members voted aye.

 

      Councilmember Godfrey moved and Councilmember Seed seconded to close the public hearing, which motion carried, all members voted aye.

 

      Councilmember Godfrey moved and Councilmember Souvall seconded to adopt Resolution 63 of 1996, which motion carried, all members voted aye.

 

      Councilmember Godfrey moved and Councilmember Seed seconded to recess as the Municipal Building Authority and reconvene as the City Council, which motion carried, all members voted aye.
